BPA still refuse to admit that the hmrc vs vcs decision is binding.

            Well they are slower then Perky he reckons he has had a barristers opinion and his contracts are valid????
"Combined Parking Solutions have referred this matter and received a barristers opinion and for this we are satisfied Combined Parking Solutiuons contracts with clients allow us the right to enforce parking charges".
But he doesn't want to post up that barrister's opinion on his website along with all his other legal stuff? Well, I am shocked.0 -

            I remember a while ago myself and a couple of other hauliers wanted a barristers opinion on a council decision to put a weight limit on the road leading to our yards!
His first "opinion" was that he would charge us £6K to look at it and give us his opinion.:eek:
We didn't bother we all moved!

A Judge of the Upper Tribunal has confirmed that the Upper Tribunal was established under section 3 of the Tribunals, Courts and Enforcement Act 2007 as a superior court of record. Accordingly its decisions establish precedents which are binding on lower courts.

Translation: We're desperately hoping the DVLA don't see it that way, otherwise there is no "reasonable cause" for them to release data, and our members' business model is in the toilet.
