Cannot have DRO Because i sold Mobile On Contract

Hi
Can some one help please
The story is i lost my job and had just got a iphone contract i rung the provider up a nd tried to return the iphone as i lost my job and couldnt afford to pay for it and they refused. We got further and further into debt so i sold my iphone that was in a contract to pay some of the debts off
Now i have been told that that i cannot have a DRO because of this, i can go backrupt at the cost of £750 but the mobile contract may not be included in the bankruptcy as i no longer have the phone
Can some one advise please
Maybe not my best move selling the phone but i had no other choice

Have you spoken to CAB or CCCS about this? Who has advised you that you can't do a DRO because you sold a phone?
If it was me, I would stop paying the contract, tell the phone company you sold the phone to help pay but have ran out of cash, and then ask them to bill you for the phone and missed payments on the contract. Then apply for DRO and include the final bill in this? Do you have proof that the money made from selling the phone was shared equally between creditors to help pay off debt?0 -
Who told you that? The phone isn't secured by the contract, if you sell it you sell it but you're still liable for the remainder of the term.
The only issue would be say if you sold a £400 value phone for £20, as you could be seen to have made a transaction at undervalue which *could* cause a DRO to be refused.
If your contract is in arrears it would be a debt included in DRO/bankruptcy. There's no way it would be something that would be excluded.Total 'Failed Business' Debt £29,043
