They should be able to provide photos of the water damageDon't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.0

As I see it, you would be on more solid ground if you had a technical report on the handset from a 3rd party that proved that it was not user damage. You can't do that without the handset back, so you may be in for additional expense if you decide to follow this up
Yes, in the first 6 months they have to prove that it is a manufacturing fault that caused the damage, but in any court, they have technicians who could give "expert" opinions and at present, you do not.
It does not matter where their head office is - if you bought the phone in England, you sue the shop. If they don't respond, they lose by default. The manager would pass on any letters to Head Office and they can't hide behind the fact H O may be in Scotland.
Your claim would be for a replacement handset, all costs involved in getting it back and technically assessed/repaired by a 3rd party who would need to supply you with a written assessment, and any reasonable costs you have incurred. In addition, you could claim for any service time you were unable to use the mobile contract.0 -

Well almost 8 weeks later and the problem seems at least partly resolved.
The phone is being repaired and after being offered 50% discount for the repair from three which I refused I was able to negotiate £15 for loss of data usage.
The whole transcript was a joke with Three made repeated errors in communication.
For information it was only after sending a deadlock letter to he Glasgow HQ that I got anywhere. The repair was only £30 which was not an issue.. But it was WRONG IMO.
I have asked for the part to be returned for my inspection (although they asked if this was necessary after the offer to repair FOC). I will be very interested to see corrosion on a pcb after 5 months! I will be very surprised however if they return it! I suspect this is a false claim. I suspect it is more likely a dry joint where the socket meets the pcb.
They have been very short sited. Most my family are on Three due to the free three to three calls. Most of our contracts end at the same time.
One positive thing to say is the shop staff have been brilliant. They no doubt see this type of thing on a regular basis. I genuinely believe that they cold not do anything to help as it was customer policy. I used to rate three as one of the best. I predict if others are being treated like this they may be in for a shock as contracts come around to renewal. What % of customers can a company afford to lose before high street stores shut?
Rant over! Nothing gained! , but hopefully something for others to learn.
Check and photograph phone before it goes to repair. Ask managers to inspect for water damage, especially around sockets. Then if you like me know 100% that he phone has not been water damaged argue and if necessary accept deadlock. I was always prepared to replace the phone myself and take this to court.

Had the exact same problem!!
Glasgow don't reply to any letters.
I eventually went into store and said "Prove the water damage". Because under the Sales Of Goods act they have to. They sent the phone away to repaired again, with a note attached saying "If phone is outside of warranty due to Water Damage, please take pictures for proof". Guess what, phone has been repaired and no pictures have been taken of the so called "Water Damage". And I haven't been charged.
Water Damage is because they cannot be arsed to look over the phone.
