If its out of date and therefore I assume useless to anyone why would you want it returned?

I think this is a rare case where to make life easier you just write it off and refund (you did agree that it was out of date?).

even if it is out of date i think the OP should have it returned, they didnt realsise it was out of date, but if they had it returned they would be able to see for sure.

For all those posters having a go at the buyer - look at it from his side. A possible post of his would be:

"Help - am I being ripped off ? I purchased some anti-cellulite cream via e-bay but upon opening it, I found that it was passed it's sell by date. This was not mentioned on the description. I paid for this in good faith. I have asked for my money back but the seller has said he/she will not give a refund until I send it back. Am I about to be ripped off ? He/she acknowledges it was out of date (whey did they not say this in the description ?), so why do they want it back ?? Will they try to sell it again and keep my money ?"

You see there are 2 sides to every story and I don't think the buyer is being unreasonable at all.

i see your point but... in order for the seller to actaully VERIFY that the item is indeed out of date they would need it returned, cause if i was the OP, i would wanna check that out for myself instead of just being told, and if the buyer is in the right he doesn't really stand ti lose anything because most sellers would refund if indeed it was out of date.

On the other hand, I've got a similar dilemma but the other way round if you know what I mean. I bought a dress which was described as worn twice and being in excellent condition. When it arrived it had two snags in the fabric and a small black mark on the back. When I emailed the seller, they denied there was anything wrong with the item as they had checked it prior to despatch. Does anyone have any advice as to what I should do next please?

how did you pay? if you paid via paypal set up a dispute 'goods not as described' but do send the dress back to the seller with a trackable delivery method

Thanks for your reply. I emailed the seller and they seemed to have a change of heart. I think they're going to reduce the item for me to allow for the faults. I can still wear the item, but didn't think it fair to pay the full price being a MSer and all!
