Thomas Cook - compensation for injury

Hi guys,
On a thomas cook family holiday in a Florida villa, the wardrobe door fell off, whacking my elderly mother on the head and concussing her.
We've complained to Thomas Cook and they offered £250 in vouchers at first, upped to £400 after we said that wasn't enough. We took her to hospital in the US, so this £400 barely covered the excess and medication of her insurance. Not to mention the days of our holiday spent looking after her.
Do you guys have any views on what our next steps should be?
ABTA, Small claims, take the offer and leave it?
We're reluctant to get into proper legal stuff, but I'm worried Thomas Cook know this and they're taking advantage.
Any advice greatfully recieved

What was the excess on your insurance? What after effects did your "elderly mother" suffer?0
-
The first thing to do is furnish them with proof of all your expenses.0

How elderly is your mother, are we talking 60's, 70's 80's cause Floridas a funny destination for old people i wouldn't fancy traipsing round florida in my senior years. What day did it happen on 1st, last etc how much of your hol did it ruin, how many of you were there.0

What a bizarre patronising response.
Are you suggesting that 'old people' in their 60's, 70's 80's should avoid Florida because it is a 'funny destination for old people'? How do you come to that conclusion?
Florida is a very popoular retirement destination for Americans to traipse around in their senior years - remember the Golden Girls? 0K - A sitcom - but a fact nonetheless.
The OP's mother got clattered by a wardrobe door through no fault of her own and her age was not a factor in the cause - it could easily have been a child with a more serious outcome.
As for compensation, that is for others to decide and as Bob the Saver has alluded to - a list of the expenses incurred would be a start.0 -
To the OP, this has got to be said, sometimes !!!! happens. Not everything is someones fault. Life is like that, just move on.
I am sorry to say that this site is becoming more of a "help me to get compo" site than anything these days. People register and post one question, "how can I make money out of something that happened" Well sometimes things just well, happen.
I am sorry that your relative got injured, BTW.The common law of business balance prohibits paying a little and getting a lot. If you deal with the lowest bidder, it is well to add something for the risk you run, and if you do that you will have enough to pay for something better.0 -

(Yep sorry, I'm an old user but new account.)
She's late 60s, history of strokes so not the best to get concussion. Happened on day 5 of 14 days, so kept all 5 of us inside for 3 or 4 days.
Anyway, she's back to normal now, so no lasting damage.
Can easily list costs, and 3 days as a percentage of the holiday. Maybe that's the best place to start.
If popular concensus is to leave it, then happy to do so, and we'll just ignore Thomas Cook and their dodgy holidays in future.0 -

Agreed, but they should not be left out of pocket.0 -
Should you not be looking to your travel insurance for this, I don't see how it's TC fault.Married the man of my dreams - 10th September 2012, St Paul's Bay Lindos :jIt was amazing.

Bletchen thanks for your reply, now we know more we can help you better.
Dickydonkin i was trying to establish if the op was a troll and whether it was worth my precious time in offering advice, and no i don't remember the golden girls. The reasoning behind the age question is how much did it affect their holiday, were they on a chilling holiday or all of them had 14 day passes for disney that they didnt get to use. How can you give advice if you haven't got proper facts.
So Bletchen you do need to make a list of expenses that you incurred and put that 5 of you lost 3 or 4 days of your holiday and tell Thomas Cook what you want from them. If you tell them what you want then if they think its reasonable you'll get it, if they don't then you can make a decision as to whether to accept what they're offering you or take it to ABTA.0
