It is a higher court that deals with civil matters that would otherwise fall within the remit of the county court. A kind of county court head office if you like.
  • thanks but is it good or should i be worried?

  • I am taking Lloyds TSB to court for charges. However I have received notification from the County Court to say that this has been pass to the High Court of Justice and is being transferred to the Mercantile Court and the claim is reserved for all purposes to the judge. They are asking that if either party wants the order set aside, varied or stayed then they should make application to the court. Can anyone help - this is way above my head and none of this seems to be mentioned in any of these forums.

Hi My claim has been transferred to The Mercantile Court in London. I have no explanation as to why and the guy at Lambeth County Court was very unhelpful in explaining why.

Can anyone here explain what it means and what happens next. I have been in the processes of reclaiming and it all seems to keep going quiet. i have spent money in doing this claim and I will be livid if after spending the money nothing happens. As not only will I have lost £1000's over the years in bank charges but also the court charges.

    Can anyone shed any light?!
    Thanks!

Have a read of the previous posts regarding cases being transferred to the Mercantile Court.
  • I am in the middle of trying to reclaim about £4k - I was offered £1k as a goodwill gesture which I refused and have applied via the moneyclaim website to take Barclays to court. I then recieved a letter from my local court asking for a further £100 fee which I paid and then recieved a letter today (about a month after I paid the fee) which i don't understand a word of - at the top it says "General Form of Judgment or Order" and it says this:

Before DISTRICT JUDGE ZIMMELS sitting at Lambeth County Court, and the address of the court.....

Upon the Courts own initiative without a hearing.

    IT IS ORDERED THAT

    1. This matter be transferred to London Mercantile Court at St Dunstands house - and the address.

    Dated 01 May 2007

Becuase this Order has been made by the Court without considering representations from the parties, the parties have the reight ot apply to have the order set aside, varied or stayed. A party wishing to make an application must send or deliver the application to the court (together with any approrpriate fee) to arrive within seven days of service of this order."

Please help - I have no idea what this means and if I'm supposed to do anyting!!

    Many thanks!!
