Claiming money back on a contract

I was with 3mobile a long time ago and have only just (oops) realized that I am still paying the contact.

Now what happened was the phone broke and I had no insurance so they offered me a replacement if I extended my contract by 6 months. Which would bring the contract end date to August 2010.

Come February 2010 3mobile rang me up saying my contract was due to expire and I could extend it. I advised them that I did not want to extend my contract. I was a bit unsure as to why my contract was set to expire when I had the extended 6 months on, but went out and got an iPhone anyway on 02. When the date they had quoted as my end date arrived I rang up 3mobile to attempt to cancel it and they advised me of the extra 6 months (which it seems they had forgotten about earlier on) and said that I could not cancel it. So I simply asked them to cancel it in 6 months time.

6 months passed (August 2010) and I called up again to advise they cancelled the contract. I thought that would be the end of it however I have just looked at my banking and it seems I am still paying £35 a month to Hutchinson. I had no idea who this was but on a Google search it comes back with 3.

What are my chances of getting this money back? And how would I go about doing it? It looks like I have been paying this charge for 22 - so by my reckoning I have payed £770ish for a contract I advised to cancel and have not been using.

  • Hutchinson is 3 mobiles holding company.

    Its seems your contract end date (after the 6 month extension) had been updated on the system, however not for the call center staff who phone users who's contract is just about to expire.

    Nothing beats writing a letter to their head office, I dont belive you will be able to speak with anyone over the phone who will be willing to resolve your issue, however it may be worth a go to start with (it may give you some additional ammunition to add into the letter).

    Things to ask:
    - what notes do they have on the account (did the user write on the account notes when you phones up to cancel?
    - can they provide you with all the notes on the account - im pretty sure they have to provide you with all details they record.
    - do they have all the phone calls recorded?


    You may be able to get refunded for the monthly charges since you phoned up to cancel, however may need to write a letter in order to get the miss understanding with the origional expiry of the contract resolved.

    What proof do you have you asked to Cancel. Verbal contracts are jsut as binding as written ones but harder to prove, and after 22 months there is little chance the tapes were kept.

    You may get somrthing back but you should have been checking your bank account more often and not noticing it for 22 months is a long time.
