We've been gazumped and I'm distraight!

    Anu...I know exactly how you feel - I've been trying to buy a particular house since Oct 2006 (I could see myself there/I felt I had already moved at times, ha, ha), however, FIVE times the vendors have placed offers on other properties then pulled out, so the sale has been on/off and my costs have soared to £1,500 (which I lose if I pull out).

    Just last week the vendors told me they have placed another offer, which has again been accepted but they cannot move until AUGUST 2007!! (Do I hold on only for them to pull out in July, are they serious about selling, etc) - Well STUFF THEM and people like them who play on people's emotions (the excitement of moving and then being let down)...a house is the home you choose to make it - and your ideal house will find you when the time is right.

    P.S sometimes we have to experience a little pain to really appreciate immeasurable pleasure! (yeh, I know, sounds corny...but true!)

    I'm sorry to hear this has happened (hugs)

    This is what I dread in the future. I've heard some EA have a 'no gazumping' policy? Is that true?

  • I'm a first time buyer, and have just had the house we had an offer accepted on pulled from the market.

    We had carried out surveys, and searches, and were just waiting for their solictor to answer a couple of minor questions before we could exchange, which they did seem to be taking their time to answer. Then we were told the sale was off as his new job elsewhere had fallen through. Whilst upset, we appreciated that this was not something that they could help.

    Now two weeks later we got a call from the EA involved telling us he had just seen the property back up for sale with a different agent, for an extra 38K above what we had agreed and 33k more than the original asking price.

    Is there no way we can ask them to pay back the costs we have lost due to their greed, even through the small claims court, as they were clearly lying as to why they didn't want to sell, and are just after far more money than the property is worth.

    Very tempted to get a friend to put an offer in, string them along for a bit, and then pull out.

    Just a thought, I don't know if it's possible but your solicitor may well be happy to exchange contracts now, with a completion date of (ie) 10th August. It's worth asking if you like the house that much :)

    My God, that sounds really scary! Personally I would be really p*ssed off (I'm sure you too will be) and even be tempted to do something silly!

    Get a couple of friends (one after the other) and string these scums along for a couple of good months and then pull out and guess what, get another friend to do the same for another couple of months - that'll teach them a lesson!

    You might not have a case against them but the EA does. There is usually a minimum tie in period and he was contracted to find them a buyer which he did.
