Should I pay them

A little while before Christmas i sold some items on ebay and accumulated sellers fees of around £40.
At roughly the same time, my better half was buying me a christmas present off ebay - a £450 bsm gift voucher.
The voucher turned out to be paid for with a stolen credit card. Police weren't interested, Paypal weren't interested - couldnt even get in touch with ebay other than via their automated email service.
So....i thought i'd refuse to pay this fee and see what they do........i get a phone cal "blah blah blah you owe £40". No problem - i replied that if ebay would only spend so much time looking after their customers who get ripped off as they do chasing trivial amounts i would be happy to pay it.
I'm now getting threatening letters. How far do you think i should push them?

i suspect you should pay your fees, and in the case of the voucher that you bought can you not reverse the transaction? or contact your credit card company? assuming you bought the voucher using the credit card via paypal. Presumably the seller you bought it from you've tried to contact? Surley in your case you have been the victim of a fraud and it should be a police matter.ummm...0

You should pay them.They provided you with a service without any hidden costs and you accepted the costs by selling your goods with them.The BSM vouchers are a whole seperate issue.0

Ebay do chase for unpaid fees through legal methods, they don't give up. So whether you want to pay or not rather depends on whether you want your credit files marked adverseley and your rating affected or not.

Please knock some sense into him!
I am worried in case not paying will seriously damage his credit rating, as he wants to borrow to buy a car later this year.
His ebay account was registered to my address, so I am worried about adverse effects on my own good credit file, and the possibility of balliffs calling at my home.Here I go again on my own....0 -
Ebay use a company called Intrim Justicia to chase there debts, they will put a mark against your credit rating, so pay it.
Re the voucher have you contacted BSM and explained in a letter what has happened, they are a large oorganisation and may under the circumstances honour the voucher0 -
BSM wouldn't honour the voucher or give any other freebies.
Nobody would help me get my money back. Ebay, Paypal and the Police all refused to help, and the seller is still using ebay. My credit card refused to pay me back, as Paypal isn't covered under Section 75. However, after a letter of complaint threatening the financial ombudsman, they gave me my money back as a goodwill gesture. Took nearly 4 months of pestering to get a solution though.
I'm still not happy that no action was taken against the seller by ebay or the Police though. At the end of the day, they sold something stolen and appear to have got away with it
I do have his full contact details including address and landline phone number which were valid as I'd called him up about it, but got nowhere with him. Here I go again on my own....0 -
So, you got your money back, this was not indicated in original post,
I must stop reading these posts that start with SHOULD I , 99% of them are unreal.
If you have a problem with Ebay then do us a favour, stop using it.0 -
Bit harsh, guess the point was that should they pay eBay even though they haven't done anything for them. The fact that the guy is still selling despite being dodgy is obviously a sore point.2p off is still 2p off!0
