Surely not if he gave his written consent to HMRC to provide the necessary info to the 3rd-party company ?

Do you think HMRC are going to provide this service when they have another duty which takes their time - to collect tax due. Providing evidence to unrelated organisations about someone's tax affairs is not what we pay them to do.

Some companies insist on a three year background check - if the applicant has not been working for that period, the employer (or the company they outsource the task to) will need to verify what they were living off for this period, hence the request for bank statements. As an alternative they would accept a letter from the JCP, but as the applicant was not claiming JSA this would not be possible.

Rubbish. A 3 year background check is just that - not in depth assessment of his financial situation. It has nothing to do with any future employer what he has been living on for the last 3 years. There are plenty of established methods of doing background checks.

It all hinges on the job. Sounds very much like positive vetting to me.

Even positive vetting doesnt require 3 years bank history - Im DV cleared and didnt have to provide anywhere near that level of history.

I have the feeling that he needs vetting and because he doesn't have any previous employment in the few years they need it for they want the bank statement.
Given that the job needs vetting and he has absolutely nothing else, then they have no other option then bank statements. But if the job needs vetting, they are not going to take just his word for it.

I would try to offer the references from professionals instead, and if it doesn't work and he doesn't need the job, he can look elsewhere if he doesn't feel comfortable.

And this third party company is most likely specialised vetting company, under strict procedures and training for this kind of job. Strictly confidential. I used to do a bit of work for one like that.

For example, this is excerpt from interview procedure that our company must follow:

Any gaps of more than 28 days should be explained by the applicant, and, where there is any cause for doubt, written confirmation should be sought from the educational establishment concerned, the person’s employer or from another source capable of confirming the reason for the gap. Regular academic summer holidays of more than 28 days, should generally be disregarded. Gap years, however, may NOT be considered as regular academic holidays. A statement regarding maternity leave may be supported by the child's birth certificate or a family allowance book. Travelling periods may be supported by tickets; hotel bills etc.

It might not be to check what he's been living off - it might be to verify that he's not been inside for three years and that is why he can't provide a checkable work history. There must be another way they can verify this though - what he's been living off is none of their bloomin' business!

Sorry to hijack but are there really family allowance books these days? I imagined child allowances were paid directly into bank accounts.

I would guess the company have hired some firm who are just making work for themselves and telling his would-be-employer that it is needed.

It could be being passed off as checking that he wasn't in a terrorist training camp somewhere or in prison, I guess if he has regular money going out to the local Asda or what have you they can show that he was in the country living a normal life. That's the only thing I can really think of, agree it is pretty stupid but there are plenty of examples of over cautious stupidity (eg the bank wanting utility bills in my 16 year old brother's name before they would let him open up a bank account...)
  • I work for a bank and to get the job I had to provide a 5 year history including bank statements for anytime not working plus I had to sign to say I hadn't done anything illegal when not working. Clearly people only do illegal things when not working. ;)

With the bank statements they were only interested in money going in (to check no alternative employment you are hiding etc) but they went through every single item going in however small. Never had it with any other job. He may be able to supply something else instead like a tax return.
