barclaycard - Suspended Account

Hello Folks,

A little late in the day we have written to our Credit Cards and asked for a copy of our t&c's and our agreement.

In the response from barclaycard, they have taken the action to suspend our account. We have been in an arrangement with them for about 6 months, just paying £100 interest free.

The letter goes ... 'Currently unable to provide a copy of the credit agreement we entered into... we accept that we are prevented from enforcing it.'

'with immediate effect we have suspended your barclaycard account... there is a significantly increased risk that you will cease to make payments'

'This is a temporary messure which will be kept under review.... notwithstanding that we cannot currently enfoce the agreement our rights continue to exist under it..... you should therefore continue to pay .... We can and will continue to pay the debt .... we can and will continue to take any action short of enforcement, which includes report to credit reference agencies without also telling them that the agreement is currently unenforceable, demanding payment from you, issueing a default notice to you and instructing a third party to demand payment or otherwise seek to procure payment'

They then go on to quote case law...

What does this mean, I simply asked for the t&c's as a starter for ppi proceedings .........

    You're in a pickle there....why don't you give them a call...only THEM will have the answers to your questions.

    it means they cant take you to court for the outstanding balance as they do not hold a copy or your credit agreement. This means the they can pester the life out of you, mess up your credit rating etc but can no arrest your wages and will not be granted a charge order against your house.

    They think your trying to get out of paying your debts back, so are protecting them from further exposure
    Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.

    Is it just me or are credit card companies becoming almost paranoid about being defrauded? Every single time I use my MBNA card these days I seem to get a phone call within hours asking to confirm whether such and such a transaction is genuine and not fraud... this morning I didn't key in the correct DOB and had to get put through to the fraud dept, I must have waited 10 minutes or more for them to answer the ringing tone, by which time my patience was wearing very thin..

    Now don't get me wrong security is a wonderful thing but I almost feel like my own card is becoming a liability to use, anyone else feel the same? Or is it just me?

    I think this is more about Barclaycard protecting their interest rather than a simply security check like what you are talking about demystified.

    I do agree though that some card companies seem to be paranoid. My Natwest card seems to get flagged up for possible fraud every 2 or 3 purchases.

    Not had any issue with my Virgin card or M&S card over the past few year and I have spent a lot more on them due to 0% purchase deals.

    The way round this is to ask them to provide a credit agreement for you to sign and for them not to be so cack-handed and lose it again. This will lift the suspension and show your willingness to normalise the account.

    I think in the earlier days of PPI reclaiming that some companies, when presented with a mis-sold PPI claim, routinely used to suspend the account - maybe something to do with this? Or they cannot find your details in the office so have put a temporary suspend on the card whilst they locate them?

    But these are just my thoughts - ultimately Stephane is right; give them a call and they can put your mind at rest.
