Won DLA appeal 3 weeks ago - but no sign of payment yet

I won DLA at an appeal tribunal hearing 3 weeks ago now. However I haven't had any correspondence from the DWP about the payment of it, nor actual payment itself. Should I be concerned?

Apparently the DWP can counter-appeal to the "Upper Tribunal" - although I've heard this isn't common, could this be the reason for the delay?

  • hi, we won our award 6 weeks ago and have heard nothing! each time we ring we get told our papers are being recalled. we were first told that payment is made in 5 days, then they were running four weeks delay and now when we ring just get told that it is being dealt with and they will look into it :( really getting down with it now as supposed to be backdated two years and cannot apply for carers allow. untill dla award on the system. we are supposed to live on 70 a week and have had to do so for three years now!!! xx rant over

    Although it isn't usual for the DWP to appeal to the Upper Tribunal, they will still scrutinise your paperwork to ensure that they cannot find 'errors in law' which would allow them to appeal. It is possible that this, along with the fact that the system is collapsing under the work-load, is holding up your payment.
  • I appealed on 27 March and received decision 25 April and was successful. The letter stated "revised award notices ... will be sent shortly" and I am still waiting and they owe me money too! I called yesterday and was given some waffle about "technical problems". I was told some other people had the same problem. Is this some ploy to not pay people what they are owed. They are quick to demand repayment but stall when they owe us money. I was given an address where I could write to complain but no info on when I can receive a revised entitlement letter or indeed my money!

    I phoned up the DLA helpline today, and apparently they haven't even received the paperwork from the tribunal yet. The person on the phone said he'd contact the Tribunals service, but its not good news if the DWP hasn't even started processing it yet.

    My mum won her case and waited 3wks for payment. However I did have to chase them. They have a special department whereby you ring via your surname and they are people whom can speed up your claim. I don't think I have the number anymore, but I will have a look and post if i do....Make sure your payment is back dated from date of application..My mother got nearly £3,000 as he claim was from 2010 and I had appealed and she won...Best of Luck x

    When we won our Trial we waited around 8 weeks if i recall for the 1st payment to be issued

    It was ALL back-dated to the trial date

    I very much doubt it's any 'ploy'. It is simply the usual chaotic mess which is our public 'services' , being unable to work in a businesslike fashion.
    I try not to get too stressed out on the forum. I won't argue, i'll just leave a thread if you don't like what I say. :)

    These delays in DWP implementing tribunal decisions are usually due to the DWP not receiving/sharing the tribunal's decision notice. You should have been given a copy of the decison notice by the tribunal? Make a copy and send it to the office that usually writes to you about your claim. Tribunal representatives often do this as good practice because of the frequent delays otherwise.

    we won my daughters tribunal three days ago!!!, backdated from august last year, do you think i will be backdated carers from that date too, as i am her carer ????
