Police and Law

Options
This is a strange one as its praise and a vent!

basically some kids through some stones at passing cars and my house. Neighbour called police and they came instantly (big praise).

They then caught one and the other handed himself in (big big praise to the police).

My vent is this - the one caught is 16 and in a care home and this is the 4th time arrested in 3 months. The police were basically saying he will get charged blaa blaa but really nothing will happen to him and he'll be back doing it again tomorrow.

I know i cant do anything as if I grab them and do anything i'll probably end up in jail. Does anyone know the law on if i grab and hold them etc. The police were great - its the law that is a joke

by the way this all started because the council didnt empty the bins - they used the bins to block road and threw stones at the slowing cars!

I assume you mean as a citizens arrest as opposed to false imprisonment?! As tempting as the latter may be ;-)

Unless you are a bit handy and if you were you would have "sorted" the problem I would keep in and call the police, you could end up getting kicked to death by a gang when they re-visit in numbers.

Here's a thought, instead of thinking about doing violence to the kid, if he is in care there is a reasonable possibility that he is experienced in dealing with that, why not try helping him?

I wasnt worried about them hurting me - there were only 3 of them and they were 16 year old scrawny kids. I'm more worried about my pregnant wife - and as you say making matters worse if they come back with more.

the problem usually is they run off and get away. I was more just wondering if i could keep hold of them until the police came. I't seems just a one of incident - but just to make sure if it ever happened again

it was obviously meant as a joke.....

yeah i'll go out with him and smash cars up for a laugh and brick some disabled womans window - nice plan

only 1 of them is in a care home. the others were just drunk and high.

Unfortunately the kids can come and go, you can't - your a sitting target. Fuelling it will inevitably go worse for you, as its likely to end up with a burning bin left at your front door or petrol through the letter box, broken windows and so on maybe for years. Unless the Police catch them with a fuel can in one hand, a lit match in the other and signed confession attached to a 10kg of cocaine in their pocket they won't stop them, even then they are let out on bail to give you payback.

Can you play opera through speakers onto the street - a few neighbours get together and all play radio 3 at a decent volume? Make the area uncool enough they may head elsewhere

I would write a complaint to the children's home they live in and request a visit from one Home Manager. Many children's homes look like 'normal' residential settings. The trauma these children may of experienced can be horrendous, and most things are done through anger/frustration/attention needing. Working with the children's home and staff there could well help the situation.

Another idea is to actually get involved in some activities the children's home do? Sometimes its not quite as easy as that, but generally, if they recognise who you are and that you are not 'the enemy' they do tend to back off.

Although I fully appriciate the situation you are in and how horrible it must be, try to work with the home rather than having the young teenagers prosecuted. Unfortunately, although they are breaking the law, by having a list of cautions and convictions when they reach working age, just pushes them into finding 'alternative' ways of making money rather than working a good job. :(
