Warranty when retailer went bankrupt

Hi all,

In July 2010 I purchased an expensive (£500) graphics card from https://www.microdirect.co.uk. It was marketed as having a 2 year warranty. The card in question is an XFX 5970 Black Edition. It has recently started showing signs of being faulty - trying to use it in other systems than I've had it in since purchase is spotty even though a friend's identical card works. There's clearly something wrong with the card and it could well have been present since day 1.

I've contacted both the manufacturer and microdirect.co.uk. XFX say all warranties are the responsibility of the resellers:
Any remaining warranty on the item would have been the responsibility of your reseller, there is no warranty directly with XFX within Europe. In this case Im afraid there isnt anything more that can be done.

In the case of microdirect.co.uk, their response is as follows:
I am sorry to inform you we cannot assist any further with your query.
We are a new company DORMIR UK LTD.
Micro Direct Ltd went into liquidation on the 14/06/11.
We purchased the Micro Direct name/website/assets etc from the financial
receiver.

Sorry for the trouble caused but we cannot be held liable for any losses experienced.

What can I do? A £500 graphics card should last longer than 2 years and besides which, it is still in the warranty period that was marketed when I purchased it!

I'd really appreciate any help.

    Not much you can do I'm afraid, unless you purchased it via a credit card, in which case they may be jointly liable.

    XFX need to pull their own finger out....from their own warranty page...

    Explain to them the retailer has gone bust, your warranty is not a retailer warranty, its a manufacturer warranty, therefore they need to deal with your RMA as the retailer of the product has gone bankrupt (you will need to push them, they should resolve it for you.

    In fact the warranty XFX have posted is pretty weak at best...


    XFX warrants that the Product shall conform to and perform in accordance with published technical specifications and the accompanying written materials, and shall be free of defects in materials and workmanship. XFX does not sell its Product directly to the consumer therefore the warranty for XFX Products remains the responsibility of your reseller where you purchased the Product.

    Sheesh!

    The warranty IS a manufacturer warranty, the only reason they have directed you to the retailer is that its cheaper for the manufacturer (they used to have propeller heads repair their cards but that was ages ago...

    visidgi seems to cover it, go back and try again with the manufacturer. Time for a screen shot methinks.
