Small Caravan holiday company refusing to refund??

The holiday was booked for the end of August still in school holidays, it is a brand new caravan and top of the range (private) but on a haven site, the company has a few on site and they could easily resale at £700 for the week when havens equivilent is £1200 for the same week. All other holiday dates are booked! Haven site passes were to be purchased by us on arrival direct from haven so that was seperate.
Nothing in terms and conditions other than full payment 8 weeks before the holiday start date.
The company are completely ignoring my correspondence and I was extremely polite on the phone, the lady managing director was incredibly rude however!
I have found Martin Lewis' sectiion on chargeback and considering I am being ignored I wonder if I can take this route I did use my visa debit to pay the £200 to the company??
You might want to contact Haven as well, they may have procedures that cover these things. The greater danger, for most of us, lies not in setting our aim too high and falling short; but in setting our aim too low and achieving our mark0 -
Not convinced Haven will want to get involved in the circumstances where they were going to be cut out of the letting loop to begin with!
How about you agree with the letting company that you want them to release the van for sale and you will only press for a refund if they do resell it? It does sound as if they were planning on cutting you some slack with the request for proof of relocation - be good to get back on friendly terms!0 -

Because there would be no incentive for them to attempt to re-let it. Indeed, why should they, seeing as they have someone already prepared to pay up for something they won't be using. The greater danger, for most of us, lies not in setting our aim too high and falling short; but in setting our aim too low and achieving our mark0 -
They do have an incentive to relet it, they are £425 down.Because there would be no incentive for them to attempt to re-let it. Indeed, why should they, seeing as they have someone already prepared to pay up for something they won't be using.
Whether you like it or not "loss of profit" does exist, it's part of contract law. They do have to minimise their losses, in this case by reletting, but if they can't then loss of profit kicks in.0 -
I've spoke to citizens advice and I'm not entitled to any money back.
I have no choice but to right it off! Very unfair I think they get to keep £275 of my money and re-let their caravan!

Why can't you still take the holiday? A house move to a different area is not insurmountable travel wise.0 -

Travel wise it could be done but the costs incurred by the move are too great. We are simply having to go without a holiday this year.
We've learnt a lesson now and we're out of pocket! The company are quids in :mad:0 -

Goes to show how very often CAB are wrong. Maybe some of the zillions that Martin Lewis is apparently donating will go towards some training for their advisers.
You are entitled to the deposit back if to lose it would be a penalty on you not going forward with the contract. As they appear to be doing very little to actually mitigate their losses (e.g. reletting it), I would say it is recoverable in full.0 -
Personally I'd be ignoring citizens advice and still attempting to get my £200 back.0

I see no evidence of that?0
