iphone 4 broken, over 12 months old but 24 month contract

Its my girlfriends, not mine before you ask, I personally dislike ithings. Anyway, so the home button on the phone has stopped working, essentially rendering the phone unusable, 3 are not interested and Apple are not interested...where do we stand on this, technically she hasn't finished paying for it, and certainly 14 months use from a £700 phone for me screams not fit for purpose...but I am unsure whose !!!! to kick, any advice?

Not sure that is correctPay for a repair, cos the fighting the giants ain't gonna work this time

In fact giants prefer to settle small monetary claims out of court (I mean the market value of a replacement phone).
As it was the network who supplied the phone it is worth searching the board for Supply of Goods and Services Act (e.g. 'goods and services'), but even Sale of the Goods Act has to do the job. This home button is a far too common fault.0 -
OK we need to seperate things.... your contract is for the SIM, not the phone, so it doesn't matter if the handset fails within the contract period. No, onto SOGA.
As to being fit for purpose, millions of these phone have been sold and there is no inherent issue with the Home button that makes it 'unfit' for purpose. Users have been known to to handle phones with disrespect (ie 'abuse') and as such the button's contacts can break. Sure, there are those who claim they can look at an iPhone and it'll break, but I treat my property with care and even my original 3GS is working fine. Proving the phone was sub-standard woill be impossible, in which case this is not a warranty repair, but it can be done quite cheaply at an independent repairer, the part is a few quid, so expect £30 for a complete repair. Check locally, as an Apple swap it considerably more expensive.0 -
My home button on my iphone 4 packed in, a visit to an independent phone shop and £25 later its good as new. If you are confident with DIY you can buy the part on ebay for a couple of pounds with the tool to fit it. I didnt fancy messing about with it so was more than happy to part with the £25!0

I purchased Iphone 4 from Apple store on May 11 2011, and in the past few weeks I had problems with battery draining fast, and delayed texting. I phoned Apple up and they advised me to do a latest software upgrade which I then did, and it solved the delayed texting issue. However, the battery still was draining fast (100% at 7am and by 4pm down to less than 10%). I have data on all time and do use my iphone regularly during the day. But I still thought it was too fast for the battery to drain down to this level.
Anyway, on 3rd June 2012 (this month) I phoned Apple again and told them issue is still there and I'm not happy. They checked when I purchased the phone and they said it was out of warranty by over 22 days.
They then advised me to take it to my nearest Apple store and it will be exchanged with a brand new one FREE OF CHARGE.
A couple of days later I went into Apple store and exchanged it with a brand new one, and didn't have to pay at all. The new one comes with a new 12 month warranty. I'm pleased with the result.
My advise is phone Apple customer care and explain to them that you are not happy with your phone. They may offer you an exchange too.

If thats the case (check your service coverage) you did well :cool: You normally only get 90 day warranty on replacements.0 -
