How to cancel a T-mobile contract, agreed through Carphone Warehouse

Options
Hello,
I really hope somebody can offer some helpful advice. My boyfriend has had a mobile phone contract for 3 years now with T-mobile. In December 2011, we went to the Tmobile shop to see about an upgrade to an iphone. We were told he was not eligible for upgrade until February 2012. As his phone was broken and he desperately needed a new one, I asked if there was any way around this. They said we could pay for early upgrade which would be about £65, we agreed to do this and off we went happy with his new iPhone 3.
Then in February 2012, my boyfriend recieved a text message from Carphone Warehouse, where had had originally took out his Tmobile contract 3 years ago, offering an upgrade to the iphone 4. My boyfriend went into the Carphone warehouse shop in Birmingham and spoke to an assistant there. He explained that he didnt think he could have an upgrade as he just had one in December. The assistant told him he was eligible as this was the correct time to upgrade, as the previous upgrade had been paid for early. The assistant told my boyfriend upgrade to an Iphone 4 would cost £150 or he could trade in the iphone 3. So he traded in the iphone 3 for the upgrade. The assistant told my boyfriend he could just use the sim out of the iphone 3, so the new sim that had come with the iphone 4 has never even be took out the box.
Then last month my boyfriend got a call from t-mobile saying he owes them over £100, when he asked what for they said the monthly payments for 2 mobile phone contracts, when telling them he only has one, they said no you have two and have to pay for them both.
Now I need to know is there any way in which the 'second' contract' (taken out with carphone warehouse) can be cancelled? My boyfriend was lead to think it was an upgrade not another contract, there is no way he would have took out another contract and given the phone to one of them back. We cant even cancel it and sell the iphone 3 to pay for the months remaining on the contract as the iphone 3 was traded in to upgrade to the iphone 4. We simply cannot afford to pay to cancel by paying the remainding months (several hundred pounds) on the contract as I am heavily pregnant (due any day now) and we dont have that kind of money.
Also can anybody tell me are Carphone warehouse able to cancel tmobile contracts as they are the ones responsible for my boyfriend ending up with two contracts?
Any help would be greatly appreciated.

Thanks

Kristina

It is their problem. If they cannot cancel they have to pay all the charges related to termination. Of course, this is provided that your friend is able to prove something. I'd expect from him to get some written confirmation of the deal from the 'assistant' in CPW, not just walk away with a shiny new phone for nothing.

You friend seems to be very naive as he 'traded in' 2 months old 3gs for just £150.
