Sorry I was trying to cut down on typing time wanted an iPhone 3 which Cpw in 1 branch say I can buy £319 but another branch say I can't buy it as they are locked. I think from reading other threads on here I am best buying from apple (although the online shop is not operational at the moment) or from CEx where they are both unlocked I just wondered why 1 branch were telling me 1 thing and another branch a different tale0

Because the staff are idiots, or maybe different stores have different policies, who knows.
You can get a shiny new unlocked iPhone 3GS direct from Apple online or in an Apple Store for £319.0 -
cpw online says Apple iPhone 3GS 8GB sim free is £319
http://www.carphonewarehouse.com/mobiles/mobile-phones/APPLE-IPHONE3G-S-8GB/HANDSET&clearance=false
so i would say the second shop is wrongthere or their, one day i might us the right one ,until then tuff0 -

Possibly both of them depending on the question.
CPW stock may or may not be locked depending on what they have and where it came from, they usuually are unlocked however if one has stock in store it may have stock from a promotion from a network that is locked. Depending on exactly what youasked they may be referring to locked or unlocked stock.
Apple are also unusualy in that locking is not done fully on the phone, when you ask for an unlock the network contact Apple, who set a flag in their database and the phone unlocks on next sync with itunes, this is diffferent to most phone where you put in a code to turn on or off the locks, and can be done without having to contact the phone. It could be part of CPW's normal contract sales process is they contact Apple via the network who then put the lock in place. Should not happen to SIM FREE phones but the sales person may not have fully comprehenhced the the questions and give the answer thats right in most cases.
That said there probably little difference in cost as Banger said so why not just buy from Apple and know it's sim free?
Think carefully about buying an older iphone, I assumed you mean the 3GS, and given the next iPhone will probably be released withing the next 3-6 months you may be better buying the 4 which will most likely be the bottom end phone by the end of the year and the 3 obsolete.0
