    Thanks B&T for all your help. I have just spoken to the deposit protection people and obtained various forms from their website to claim the deposit back - they agree with you that the ball is now in the LA's & LL's court to prove any damages etc. Will fill out forms tonight and email them off. Thanks again

    Be aware though that either party can refuse to use the arbitration service. That means having to use the court to decide the issue.

    Just wanted to say a big thank you to everyone who helped me with this situation. The dispute has now been resolved by TDS in our favour because the landlord did not provide sufficient evidence for his outlandish claims. So thanks guys - you all really helped when I was quite desperate. Sun4
  • It may not be over yet. If the landlord or their agent are intent on imposing that probably spurious £6k charge they do have the option of commencing proceedings in court. I daresay that the six grand was far in excess of the deposit amount.

    Keep all of your documentation in order and to hand. I hope you won't need it but you never know....

    Thanks B&T. The LL might try to take us to court but I think his lack of evidence will be a stumbling block. He was unable to supply the TD S with any documentation at all to support his claim and I'm not sure what he would produce in court. Still, some people don't know when to stop do they? So will keep my folder of evidence to hand!
  • Just because no evidence was presented to the arbitrators does not mean they don't have any to support their claim in court for that six grand.

    Just a quick follow up for all the kind people on here who helped with this dispute. LL did issue court proceedings and we decided to dispute the case. LL did not pay hearing fee and case was struck out. I suppose he could try again but hopefully this has finally been put to rest!
