Parking eye charge at fistral beach car park. Advice needed please.

Options
Took the family over to Fistral beach carpark in Newquay. It was raining bad so stayed in the car for 5-10 min before gettin a ticket, then went in a local shop on site for change and then paid for an hour.
Went and bought some stuff and then left.

Arrived home in the sunny North west and 3 days later I've got a parking eye ticket with a time in and another later time photo of my car. Runs to 1hr 20 mins.
So I appealled and stated that a ticket was purchased. Came back unsuccessful so I appealled again and quoted them about an act that they can't take a fine that's immeasurably more than what I went over if any. I also forwarded a receipt for goods bought in the surf shop. Came back today unsuccesful!

What next? Any good advice will be appreciated.

Well your appeals were a waste of time

There is no such thing with ppc's.

Just ignore from.now on and ignore any letters.

    Nothing else needs doing.

Ok first you need to understand how the appeal process works.

Your letter turns up. The gorilla sitting at a desk in a scruffy wooden hut on a scrap yard full of cut and shut cars and stolen war memorial plaques opens it and passes it and all the others to another gorilla sitting on another desk. The secoind Gorilla screws each letter up into a ball a lobs it 25 feet into the waste bin. he never misses, cos he had lots of practice doing this. He then prints off a standard 'appeal rejected' letter and sends it off to you.

What such companies operate is called a Misrepresentation of Authority Fraud. You have almost grasped it, but haven't the courage of your convictions.

First of all, as you almost guessed, it isnt a fine, they have no power to fine anyone, they are a private company. Its a speculative invoice, an invitation to pay a charge that otherwise they are not entitled to ask for and have no ability to enforce.

The only way they get peopel to pay this charge that they have no right to is to lie to you, and to try and fool and scare you into paying. Do not fall for this.

They cannot make you pay, because you legally owe them nothing. They cannot enforce this mythical debt in court, they get spanked and ejected by the court. There nothing they can do, but theyWILL try and scare the bejeezers out of you, and convince you all sorts of bad things will happen if you dont pay.

Its all very convincing, and a load of rubbish. Its complete bollox.

So, the only plan you need have is to ignore the rubbish they send you in the post. There nothing they can do, because you owe them nothing.

SO, ignore them, ignore them and ignore them. Think no more of it, Its all rubbish. ;)

    What did you expect?!!! :rotfl::rotfl:

Do you also reply to phishing emailers when you've 'won' the Nigerian Lottery?

Seriously, any private 'ticket' is a SCAM. You should've ignored it but you still can. No harm done!

You will get the same letters we all get - but they really are very easy to ignore. All the letters can be seen as picture previews, in the permanent info 'sticky' thread near the top of the parking forum. Nothing else happens, no CCJ, no affect on your credit rating - that's why we say it's similar to a phishing email scam (looks like a parking ticket but it's not a real one, follows up with debt collector scary letters but they are just templates and just hot air as there is no debt, no fine at all because a private company cannot fine anyone).

See my signature for the words to click on, in order to take a step back and see the current thread list (sorry if it's obvious, I can't tell, as some newbies know how to nip around a forum and others don't). One click and you see all the current threads here. Third from the top, click on 'PPC letters & threats'.

    1. Watch the Watchdog clip on there, and then

    2. scroll down to the pics of Parking Eye's threatograms, then

    3. Play a nice game of snap with each matching templated threatogram, then

    4. Tell your friends & family about the fake PCN scam so they never pay one.

HTH and have a nice Summer! :)

There's bad news and good news.

The bad news is that you wasted time and stress on their utterly fake appeal system.

The good news is that you found us before giving the scammers any money.

So, don't give them a penny, and don't waste any more of your precious time on Earth having an argument with total idiots like Parking Eye.

Simply forget any of it ever happened and get on with your life.

After you have ignored a few of their asinine letters, they will forget it ever happened, as well.

The Nigerian was very polite indeed :rotfl:

Anyways, cheers all for your input. I appreciate the info.
So will letters still appear and if so what am I likely to receive next and when will it stop?

Let's just say I did go over the parking time by 20 mins I now assume that they can't do anything about it and that's- that?

You can see what you will receive in the way of letters when you look at the sticky thread I mentioned. The letters last a few months, about one a month and you can see from the thread how many letters each company use. Have a look now, as explained above, and watch the Watchdog clip on there too. :)

Sorry about the Nigerian Lottery quip! :o

They will not do anything about it, end of. A recent Superior Court ruling has established that parking companies cannot take anyone to court in respect of someone else's land.

If you want to cut the letter chain short, try returning all letters they send you after writing something rude on them, in an envelope without a stamp. They soon tire of that game.

Treat them with contempt. We all do.
