Of course not. But neither do I expect an identical phone package to be offered at a lower monthly rate to new customers only - which is what Three are doing here.0

Spot on analysis of the situation there! Buzby clearly hasn't read Dr Dyson's paper, or most of the previous posts prior to jumping in and posting. This issue with Three is all about their contract wording which failed to sufficiently define what changes they can and cannot make without activating 10.1d).
Do you have a link to Ofcom's definition of "materially detrimental"? Andrew Dyson's current opinion is that "detrimental" and "materially detrimental" are both the same, and that any price increase is detrimental / materially detrimental unless otherwise defined in the contract.
The term Three were looking for is "significantly detrimental" which carries some legal precedent: that of significance to the consumer. Sadly for them they picked the wrong word.0 -

Are there any updates for this case. Just getting worried that if I use my phone after the 16th July they will assume I have accepted the change. Unfortunatley I cannot afford to pay off the £500+ left on my contract and claim it back.2010 Wins:

The following thread from the Which site recommends informing Three that you intend to 'pay under protest' until a court precedent is set. If it rules against Three, your account cancellation will be free of charge.
This needs to be registered within 1 month of the original notification (which for me is within the next two days)
