Seller does not want to proceed as went for lower price than he expected

Good morning
Some advice required from you e-bay experts.
Have been bidding on a bike. The highest bidder cancelled there bid 3 minutes before the auction ended and I then became the highest bidder. The seller is refusing to sell at the price the auction then ended at. The highest bid was £850. I have now won the auction at £700. In between time I had bid as high as £820 but of course that bid of mine was cancelled when the highest bidder cancelled.
Are they allowed to refuse to sell at the final auction price?
I did make an offer several days ago - which was in fact for more than the final auction price - the offer was accepted but they would not remove the bike from the auction unless I paid cash in advance - we offered to do that last weekend but the seller said he was away for the weekend.

Here is an extract from ebay's T&C's so you should have a very good case for reporting him. Suggest you email him with this first.
When a seller lists an item on eBay, and a buyer bids for and wins that item, the seller and buyer have entered into a contract. Both members are expected to honour that contract. In accordance with that contract, the seller may not:- Fail to deliver an item for which payment was accepted.
- Significantly misrepresent an item by not meeting the terms and item description outlined in the listing.
- Refuse to accept payment for an item at the end of a successful sale.
Breaches of this policy may result in a range of actions, including:- Listing cancellation
- Limits on account privileges
- Account suspension
- Forfeit of eBay fees on cancelled listings
- Loss of PowerSeller status
- Referral to Law Enforcement

unfortunately you cant force a seller to sell it to you......you can file a non performing seller report though...0

Despite what eBay say about it being a binding contract, etc. ultimately they can not force the seller to sell the item if the seller doesn't want to.
As madbazoo says, you can contact the seller and point out that they are breaching eBay's rules, but I am guessing they already know this.
If you really want the bike, then you could try offering more money for it, but be aware that if you do this, you will be buying it outside of eBay, so you need to ask yourself, do you really want to trust a seller who has already proven to be untrustworthy? (The chances are, this is what they are hoping for where you had already offered more for it).

The guy seems a bit of an idiot. Tell him it's not on and file a complaint.

Thanks for everyones advice. Not sure I understand this - how did the seller cancel the bid and if so why is he complaining about it being cancelled?
I have heard from him this morning - basically his reply is
"Do what you have to do - but I am not happy to sell at £700. You had already bid more than that before the other bid was cancelled"0 -

Maybe the seller had a mate who bidded up the price in the hope that someone approached the price he really wanted.
Illegal , unethical and against eBay rules... :mad:0 -
