Son used debit card without consent , advice needed.

I found out today that my 10 year old son had been using my bank details to purchase numerous games on his play station 3 account , he has also been sharing his account with one friend of his so u don't know if he has also been buying games from my money , anyway I phoned my bank and they said to contact the fraud department and also to contact Sony as I am overdrawn by 500 pounds because of this , the lady also said my sOn could get prosecuted for this as its fraud ? All I want to know is will I be able to get my money back ? Any advice very much appreciated, thank you .

I would hardly think of it as fraud to be honest. Theft from you but fraud, I think not.
What does your 10 year old say about all this then, does he still have all the goods he bought.make the most of it, we are only here for the weekend.

Can't see your son being prosecuted ! You would have to prosecute him !
I don't think you'll get your money back though from your card issuer as you shouldn't have allowed him to have access to your card details. Harsh lesson learned really. You should insist he pays it all back.0 -
I'd be amazed if the police or CPS would think it was in the public interest to prosecute a 10 yr-old for fraud, even if it was legally counted as fraud (which I doubt, but I'm not a lawyer).
Did you input the account details into the account in the first place? If so, or if you left the details in an accessible place, then I doubt you would have any claim on the bank or supplier.
I hope you have made your son very aware of how serious a problem he has caused - if it was me I think I would be selling the PS3 to recoup some of the money.loose does not rhyme with choose but lose does and is the word you meant to write.0 -

Punished is appropriate, but he really does need a good talking to, does he realised how serious this is and the fact that he has stolen this money from you.
Have a word at your Police station, ask them to talk to hime and absolutely frighten the life out of him, take him down there if you can.
He needs stopping in his tracks right now, not when he hits 18 and he gets caught hacking into the USA military system. Silly I know, but it happens.
Hope everything goes okay for you. I really dont think you are going to get any money back. Sell his machine and all the games and any other device he has.make the most of it, we are only here for the weekend.

This is as much a lesson for you as it is for your son. Don't let a ten year old have unsupervised access to your card details and then place him in a sweet shop otherwise bad things will happen.
Also, you have no chance of getting your money back, sorry. Take this one as an expensive lesson learned.

A ten year old will not be prosecuted for using his mum's debit card.
Send him to the naughty boys' home.
Getting money back is unlikely. But do contact Sony, they may (may not) offer you something.0 -
