Trying to cancel my contract with T-Mobile

Hi guys,
I have earlier today tried to cancel my contract with T-mobile - I ordered an Galaxy S3 two weeks ago - I have been told my the representative i'll have to wait up-to another 4 weeks before I receive the phone.
The customer services rep stated that there is a worldwide shortage so I could be waiting awhile - I asked him why I cannot cancel a service have I am yet to receive and he just stated I would have to wait for the phone to be received.
He was very rude & condescending throughout even after I told him his manner of how he spoke to me was causing me some upset.
Can someone tell where I currently stand on this matter? I could be 6 weeks without owning my phone.
Surely I can legally cancel a contract with them while they have yet to provide their side of the deal (eg the new contract AND the new phone).
Can anyone state where I stand on the matter?

1. Did you order on line? If so, read their t&c re returns and follow them to the letter.
2. Write a letter/email to their Chief Exec pointing out that you wish to cancel in advance of them fulfilling their part of the bargain, how it would be a waste of his company's money to send out a handset that they might have to sell as refurbished when you return it and that promised delivery was a fundamental part of the contract on your part.0 -
I ordered this over the phone rather than online - but sending a letter would certainly be a good start. I cannot believe how rude some of these customer service reps are some.0

When you do receive the phone ring them up and tell you are returning it unopened you have 7 or 14 days cooling off period to return it and cancel the contract as long as you don’t switch it on Iv done this with 3 before

Thanks for the advice beanys - I know the have said there is a 7 day cooling period (used to be 14 what happened there?!)
I will complain either way but I think I'll just do that0 -
It can be not that simple. There were to parts of the distance sale: contract and phone. The contract seem to have started already according to the OP - and has to be cancelled within 7 working days from the start. T-mobile will deny any link between the sale of the phone contract and the airtime contract.0

Sorry - might not have made it clear. T-Mobile have stated I have 7 days to cancel from the date I receive the phone (and the new contract). As I haven't received this yet I am not currently in a new contract - which is stupid really as I am simply trying to cancel a new contract which actually hasn't started yet?! (Does that make sense.. cos i'm struggling lol)

Don't think you are correct this time, Grumbler. DSR gives you a period to examine the goods sent. So OP has right to reject handset within the longer of DSR regulations or the vendor's period as specified in their t&c.
In any event, the contract for airtime can't begin till you receive the sim which is usually inside the handset box.0 -
