payday loan helpp!!

Hi, I recently lost my job due to sexual harassment off a member of staff. I am now on benefits, waiting on Income Support to be sorted. Please do not judge me for being on benefits.

Anyway, I got a payday loan from PAYDAYUK in March, I lost my job before the repayment date, with what happened at work i wasnt very stable I forgot all about it, the direct debit declined and i rang them and explained my situation, the man i spoke to was very rude and put the phone down on me! I rang back and tried to reason with them on a payment plan and was told I would be contacted by one of thier managers in the morning, I waited and never got a call ..The following day I went to my bank and all my money had gone ( My Child Tax and Child Benefit) I rang them and asked for them to refund the money as i have nothing to live on for 2 weeks and i need to feed my child and buy nappies ect: I did not authorize them to take this payment, they kept on asking for my card details to verify them but i told them over and over again my current situation but they never took any notice. Since then The money that they have taken is still showing up in my account balance after a week .. I spoke to the bank and they have told me to come back in the morning and they can try and help me, I have also phone DWP and they have stated that the company PAYDAYUK, can not take my benefits as that is what the government says i have to live on, and plus I have no other money coming in for another 2 weeks. I emailed the company and my reply was 'Oh well, your bank authorised it so we took it' how horrible!!! so here I am asking for advice as im stuck on what to do .. Also I dont know if this means anything, but i have tried to search thier registration number on the Office of Fair Trading register and nothing has come up for the company .. Could this mean anything?? Thank you. :mad:

    Hi,

    It sounds like everyone is fobbing you off by saying come back in the morning and someone else will sort it out.

    These pay day scummers are legally allowed to recover whatever money they can from your designated account. if you pick through their t&c's, which i assume you probably did not do when you wanted the money, they will have their backs well and truly covered, because dealing with people who "forget" about their loans is what they do for a living. If they got sued by the OFT every time they picked at someone's account or sent a fruity email... they would not exist.

    Now what to do about it... firstly you should get a second bank account asap and get your benefits paid into that. they cannot raid an account you have not given them details of or authorised them to on your application. Secondly, write them a letter about the situation to bypass the rude call centre monkeys and suggest a repayment plan. all they can do is say yes or suggest an alternative.

    Do those 2 things and they cannot take any more money from you and you will be able to resolve the default with them in a professional manner.

  • Thank you, I have read through their contract and T&C's and it mentioned nothing about taking money if the repayment was not made on the agreed date. OFT have not got any record of their registered number on the registered search on their website. I have also researched this company and they have done this to alot of other people too ( I wish I did the research before id taken the loan) some people got their money back and some didn't. Hopefuly the bank should be able to sort this out in the morning. I have learned my lesson now never to borrow from any payday lender. I will cancel my card and open a post office acount i think thats the safest thing to do. I have tried to reason with them but they are so ignorant and rude towards you, as if they have some kind of control over you. I will get on writing this letter now and I will also report them. Thanks again I will let you know how its gone on at the bank tomorrow!

    Payday loan, lost job immediately afterwords, cant pay it back, baby to feed, need nappies, nasty payday company stole their money back.

    This one has them all!!!

    How did YOU lose YOUR job through sexual harrassment ? Wouldn't it have been the other person who should have lost their job ? Did you take this up with your employer as it sounds unfair to me.

    I understand why you're angry but it's not company's fault that you're in this unlucky situation, is it? You take a loan and you agree to pay it back on a certain day, and if you don't, they are trying to take money out of your account whenever they can - I would not believe no one told you that.

    We have so many customers who don't care about things like that when they're signing all the papers, they come with an attitude "oh I'll just give it back before due date, I don't need to know all those details", and then they get into trouble and blame us for everything. And so often they are actually telling half the truth, I've personally stopped believing them.

    And even if I'd like to help customers like you, there is always someone above me who tells me what to do, so it's not up to my good heart really.

    Representing my own views. And I am still working for my company only because it's better than being unemployed, not because I like this kind of business - I actually don't. But nor do I like customers who are trying to blame others for their own mistakes.

    The OP clearly said they had tried to make contact and the company was rude and obstructive,how is that the customers mistake? There facing the problem responsibly by contacting the lender straight away and trying to deal with it,its these PDL companys that make it hard to repay so they can claw more money into there grubby pockets

    Is there a Direct debit set up? if yes, you can get a refund via an Indemnity, but a card payment, does that not authorise a company to take any amount? Someone will know soon i expect.!
