Final months rent/deposit

If you dont pay your last months rent you will be in arrears when you move out and your Landlord can take you to court for unpaid rent.
I think reasonable to assume that the LL would first try to recover the debt from the deposit... A landlord would be mad to return the deposit in such case.
OP, maybe a bit late, but very first thing to do is to check whether your deposit is indeed protected through one of the 3 schemes.
If it is, I would be firm re. viewings but pay the last rent.
If it is not, I would also be firm re. viewings, and consider withholding the last rent as an option.0 -
dlk - you've posted elsewhere on here that you have 3 BTL properties.
What would your own reaction as a LL be if one of your Ts failed to pay the final months rent?
For goodness sake, just check whether your own tenancy deposit is scheme registered and if not tell your LL that he has failed to meet his legal obligations to (a) get the deposit registered and (b) provide you with the scheme's prescribed infiormation.
The Localism Act has tightened up the law on deposit registration - your LL may be interested to know that he can be charged apenalty of between one and three times the deposit amount for not complying with the law. Having that drawn to his attention ought to make him return it in full to you, pronto.
But then, you would know about the changes as a LL yourself ............0 -
Are you planning to pay compensation for being more than a month behind in the rent? If you are really trying to be reasonable you probably should.
Or maybe when it comes to it you could tell the landlord that if he wants to access any of the deposit he only gets 75% of the rent due and you get the rest as he has been so unreasonable. Why move out at all?
Not suggesting you are thinking of this at the moment but once you default on the rent things can escalate and you can expect the landlord to be unhappy.0
