Sorry for your wifes accident.
But it seems like you really after compo.
Small claims court... = around £1000 - which we have said will go to a charitable cause.
As a household which has a 6 figure joint salary and 70% of the mortgage paid - I can assure you that £1000 will make little/no difference to us.
Hence why we recently donated all of the money at our wedding to a local charity in recognition of the good work they do.
So, before you "read", please also try to digest the information.
Unfortunately the only way you can punish companies for their poor products is in the pocket - that's just the way it is.... 'mate'
also, I quite like a little battle with a big boy - it gives me something to concentrate on outside of work.Hating Hastings Direct!0 -

I'm not sure a small claims action will against Duracell will succeed. Duracell have offered £100 and OP has rejected this twice. Super_dad have you attempted to negotiate with Duracell? If not, I'm not sure how that would be viewed in Court. Also could the Dulux paint unit used not be at fault?0

I can back up what you have said about batteries exploding for no apparent reason. I have experienced this twice, and this evening, almost a third time.
A couple of years ago I woke up in the night to a loud snap/bang. After the initial shock I assumed it was a mains electrical appliance in which the internal power supply had just blown, and while I couldn't see anything obvious that was off (tv, alarm clock etc), there was no smell of burning so I eventually got back to sleep. A couple of months later I was going through one of the draws of the bed side table and found a Duracell PP3 battery that had burst open with some force. So that was that.
Last year I was working when the same thing happened - this time it was a AAA battery, though not a duracell one. It exploded and shot the shell over to the other side of the room which gave me quite a shock (not electrical!).
About an hour ago I began to hear an odd sound near the window. I assumed it was rain against the window, but it wasn't raining. I then found the sound was coming from a Duracell 'D' cell that has been on the window sill for a good while. It was quietly fizzing/crackling, though it did not feel hot. I've now put it outside and surrounded it with bricks! I may find the bricks have moved by the morning! We'll see.
In all 3 cases the batteries involved haven't been used for a long time (over a year). I tend to put used batteries in a plastic tub and when it gets full take them to the battery bank, but I think its better not to leave it too long between trips.0
