exploding duracell battery and acid burn...

It could be a wrongly inserted battery, if the terminal at the top shorts to the side, because it's caught wrongly across the terminal in the paintpod, it could be a defective terminal in the paintpod causing a short, or could one battery have been out in the wrong way round? All will cause the battery to overheat.
The paint pod was working for a few minutes so this is unlikely.Pants0 -
Your wife may find she isn't allowed access to her own records as they are supposed to be blocked from the system user to prevent alterations, if I was her I wouldnt even try to access them as she could be accused of alterations futher down the line, and possibly be disiplined. You should both follow procedures to the letter so you have the best chance of recompense, dont give them an excuse to refuse you - its shocking what has happened. Going tell the OH thatswhy I will now refuse to decorate . . .On a serious note, I hope your partner gets some sort of compensation, even if she burns heal for the wedding she will still think they can be seen0

But seriously, I hope your fiance is feeling better, it's a horrible thing to happen at any time, but 6 weeks before your wedding it even more distressing. It sounds like you have done everything right so far.
A perhaps trivial concern - but just in case it is helpful, I thought I would mention that you can get special concealers to cover up burns/scars if your fiancee is worried about that for the wedding. I think doctors can even prescribe them.

He says you could sue Tesco for negligence, Duracell could sue Dulux for infringement of copyright, and you could sue Dulux. He recommends you start with Dulux.
Oh dear.
Tesco - action lies in contract. Proving negligence will be impossible.
Duracell and Dulux - Consumer Protection Act 1987 on the grounds of unsafe product.
Infringement of copyright has absolutely no place here.
As others have said, see a specialist Personal Injury solicitor. Pre-action protocols apply to PI claims so unless you want to become an expert, best to see someone who knows.0 -

well I wouldn't say that we're only complaining "to get a few quid"... this is a genuine worry as only minutes earlier the better half was carrying our newborn son. Hopefully there will be no ongoing scars and her eye will get better with time...
We certainly don't "need" (as far as anyone doesn't need cash I guess) the cash and our intention isn't to screw these guys for everything we can, if they continue in their current stance - which, so far, has been admirable and professional.
I dare say that an offer will be made by duracell once our story has been confirmed by medical reports and sending off the batteries - as long as it's fair and we accept their explanation then we'd be happy... I guess - if they go out of their way to deflect blame onto others and don't just hold their hands up and say "yup.. there was a problem... sorry" then I think we could pursue it further.
I'd sooner not have a long drawn out case with Solicitors... lasting 2 years for the sake of a few grand or so. hey, if what they gave us paid for a break for the family then we'd be happy... assuming their explanation was honest and genuine.Hating Hastings Direct!0 -
It could be the paint pod is to blame, liability hasn't been established yet. Duracell will no doubt blame Dulux and vice versa. It will be a long drawn out affair, one you had better hope a no win no fee solicitor takes on as it would be very expensive to go it alone.
Batteries rarely explode, when the do they go very hot first, your partner was holding it in her hand before it exploded, didn't she notice it burning hot? Don't also be surprised if they blame user error for the fault, mishandling batteries can also lead to them exploding.0 -
