    You persist in ignoring the key fact - which is that there is no current GSC - it expired in April - and LL appears to be reluctant to get a new sorted out, preferring instead to fiddle with the boiler himself.

    Therefore,the suggestion was made to the T that they should contact HSE

    It's not that hard, really it isnt.

    As for the other reponse to Sequence's post
    What gets posted on these boards should not be taken as advice - open forum, and *anyone* can post - its suggestions and opinion. A Lls failure to repair does not give the T a right to walk away from their own obligations under a tenancy agreement. In some cases it ought to be the case.......but that is no different from a LL whose T is not couhging up the rent not being able to simply renege on his own LL obligations.


    I think you're clearly not grasping the simple concept that there are 2 completely different aspects to this thread.

    The first being that the gas safety certficiate has lapsed. That I agree does require to be dealt with by a registered engineer, I have not disputed that. Although I will say that it expired in April...hardly something to get the HSE involved is it?? We're talking a few weeks, in fact I wouldn't mind betting the HSE would probably put this fairly low on their priority list given the time lapse is so short! But this was never my argument, so I fail to understand why you keep nannying on about it like a broken record.

    My point, was the one which referred to fixing a broken boiler, and the LLs right to do so under what circumstances. If the LL believes it's a water pipe that needs fixing then please tell me WHY he can't do that?? THis is my point, nobody knows thats its definitely a gas related problem yet everybody is so quick to jump to that conclusion and start setting hares running over what could be a quite easily dealt with situation.
  • Hi my girlfriend started renting a flat that was above an unrented space. After six months a couple rented the space below and opened a coffee cafe. Since the. We are kept awake by the fridges downstairs and woken by the couple at 7am Monday to Sunday each week.

    1. Am I right in thinking they should have a reduction in council tax?
    2. Because they live on a corner the bin men do not pick up there bins for weeks on end and my gf has rung the council at least ten times in the past couple months. Is there a break down to the council tax so they can (if possible) get a rebate for weeks rubbish has not been collected.

  • Firstly Thank you for all the replies, and apologies for not updating over the last few days, been a bit chaotic asmy OH was rushed into hospital as well :(

    Well, the LL arrived on Tuesday full of smiles proceeded to "check" the boiler, i was not happy when he started removing parts and even unhappier that once he had found the 2 faults he still intended to repair himself. At that point i had to put my foot down, i stated that as he had to get a gas cert anyway why not get it done in one go and phoned up a company who said they would come out, the boiler is now fixed, working fine and i finally have hot water :T

    To clarify 1 fault was with the gas side, and 1 was the computer thingy.

    Whilst here the LL was approached about his pretty foil covered fuses, seemed very non plussed when my OH stated how dangerous they were, he then said he would be taking the blown fuses home, re wiring them and would post them back for re use :eek: at which point i said please dont, bother :rotfl:

    I can see all points of view on the LL and this situation, unfortunately he is one of those that tries to cut corners with things because he doesnt want to spend money, he said that the cost of fixing the boiler will be reflected shortly in a rent increase when we re signed tenency in April.

    You live and learn and our lesson on this will be to get out next April when Tenency ends, we are fortunate enough to be inheriting shortly and in a position to buy outright and cant wait to be free of renting :T

    Well done.

    If you're in a fixed term contract, I don't think the LL can force you to raise the rent during it - irrespective of the amount he's paid out to comply with his legal obligations with the boiler...

    I see a little knowledge is still dangerous!

    Ghostrider, it doesn't have to be "gas work" or "flue" to be breaking the Gas Safety Regs, there are lots of situations where the LL can make the boiler unsafe without touching the gas directly! Ive had landlords sticking silver paper in PCB's to stop them blowing fuses, disconnecting overheat stats, its actually anything that may cause a dangerous situation to arise with the gas appliance in general. You are being misleading when you say Gas work, you cant fit a PCB unless you are gas safe registered because the boilers operation, after its fitted, needs to be checked. He does sound like a dangerous idiot, knowing him makes no difference!
