Hidden charges that I wasnt warned about. Do I have to pay?

Hi, I took a phone to be repaired. The guy said "leave it with me, i'll have a look, and i'll call you before I do ANY work and let you know the price". The did not tell me about any charges at the time. I agreed for him to look at it, and as I was leaving he handed me the terms and conditions, which he did not give me before he had taken my phone off of me.

The terms and conditions said that even if he did not work on the phone, there was a £10 charge for his time.

Should I have to pay this fee? Shouldn't he have told me about it before I agreed? Is there a way I can challenge him about this, as I feel it is totally unfair that he didnt explain this.:mad:

    What papers did you sign? Did you read them before you signed? Chances are the 'papers' you signed were the T&C's and had you read them, you would have known about the £10 charge.

    Any contract is only valid if its terms are written above your signature unless it says I have read and understood the terms and conditions

    No, by this I meant that I agreed to have him take a look. I see the post isnt very clear, i'll change it.

    He didnt show me the terms before I gave him the phone, and he didnt warn me of the charge either! :-(

    So now you're saying you didn't sign any papers? It still says that you did in your last paragraph. You can't delete information in your posts to make you look like the innocent party!

    You should have read what you were signing before you signed it!! If you did indeed sign anything?!

    You've edited your OP twice now and are now saying that you didn't sign anything after stating twice that you did in your original OP (which is quoted in post 2).

    I get the impression that you did infact sign the T&C's and are now just trying to get out of them before you didn't bother to read them!

    How on earth did you manage to say (twice) that you signed the papers if you didn't sign anything? How does that accidentally slip in? It doesn't. I stand by my last post. You edited your posts to cover the fact that you are in the wrong!
