This really does amaze me.

I don't see why it would amaze anyone, and I doubt that leaving for such a reason would impress a prospective employer either. JSA is there when you have no other option, not for those who are a bit precious about working long hours.

I have no problem the odd hour here or there, not 3 hours per night 2-3 nights per week.0 -

Not wanting to do overtime without the traditional enhancement of time and third, or time and half I really agree with the OP here what incentive is there to do it. I doubt it would be gross misconduct refusing to be the works cat, but if a reasonable amount is in your contract then maybe do a few hours in the week.0

Mine are legal as I don't do it for them. But if I did do it they would not be legal, and if I was sacked for said reason I'm sure this wouldn't be legal either, but then they would just use a different reason to sack you, lack of work or whatever.0 -

Many employers pay OT at basic rate now. The incentive is surely that after months of being unhappy at being out of work, he has an income.0 -
I think really if it did happen it would just have to go to a decision maker and let them decide, probably just depend what mood there in.0
