6 week old Xbox 360 has ruined 6 games !! help please

I have moved my 360 while running, I kicked it off the bed once and it didn't scratch the disk
If they come back saying it should be played flat then ask why it is also designed to be used vertically?
It is a known fault, don't accept a repair you bought it from game so they are responsible to sort the problem out, if they want to send it away to MS then request a full refund for both the console and the games bought from them. The games bought from elsewhere you will need to try return them to the places they were bought from just tell them they dont work don't go in to any details why they dont work just asume they were faulty from the off, if they ask why it has taken so long to return them say the console and games were a present and have just been given in the last 2 weeks you will need the recipts for all this BTW
Game cant accept them back in an ideal world they should sort them out but they wont as they were not bought from them. If you get no where from the other shops contact MS and tell them the games have been dammaged by a faulty console they should sort them out.
Failing that game station have a disk restoration machine that polishes out scratches maybe you could try that and make a claim againts MS or game for the costs involved.

My son has had the same problem, I got him Rainbow 6 Vegas with the vision camera for Xmas and that scratched within a few weeks, he went and got another copy with some birthday money he had. We mentioned it in the shop and then chap said it was the XBox 360 if it moves about and dh told him ours does not move as it is in a unit and secure. It does seem like a fault with a lot of these games and they are expensive enough.0

It's a known fault so take it back to Game and stand your ground until they replace it. It's not fit for purpose.

The 360's are designed to stand vertically as well as lie flat. A properly working dvd drive is not affected by it's orientation. Perhaps the drive motor is slightly off kilt causing the disc to have a wobble causing it to scratch on the drive tray or worse is the lens touching the disc surface.0

just to update:
as this was a gift i managed to get the receipt from the purchases and saw it was actually brought at Comet. went there yesterday armed with the console and damaged games.
however despite my arguments i was only offered a repair (2/3 weeks) - assistant said this is the second xbox360 this week with the same fault and that microsoft have already stated no compensation to be made for damaged games.....felt i had no choice but to accept repair.
when i got home, i read everyones posts above so phoned Comet customer services to insist on replacement.
was told their 'policy' is too only repair xbox 360s if you have had it less than 2 weeks (6 in our case) despite the fact i said i had spoken to Trading Standards. when i asked about compensation for the games, they put me on hold to speak to a manager - then came back with questions as to what does the damage look like, then back to the manager who apparently said 'no comment at the time being'..............??had enough of :wall:

I wouldn't accept that. You want a definite answer yes or no. If yes fine, if no then take them to small claims. As for giving what Microsoft have stated about compensation, that's completely irrelevant. Your sales contract is with Comet not MS. When I had problems with 4 week old XBOX, I was being fobbed off by the retailer, following help & advice on this thread, and armed with above info re sale of goods act, I received brand new replacement within days.
I wouldn't recommend contacting MS as I believe they will only offer you someone elses reconditioned one as a replacement

No, their "policy" is irrelevant. You're protected by your rights as a consumer. Get to the store again, and ask for a replacement. Say you're not willing to wait 2/3 weeks for a repair. You were sold something defective, have returned it, and want a replacement. Why should you have to wait while they liaise with MS to get it fixed.
If they still try to fob you off, mention the Sales Of Goods Act 1979 and that you're aware of your rights as a consumer. Then start taking names, details etc... (always keep a log of such things anyway) and say you want to take this further. Ask to speak to someone more senior if the current person isn't helping. Basically don't back down.
My friend has a similar thing with Apple. He went to the store, and they said it would take 6 weeks to repair and went on about "their" policy. So I went along the following time and we made a load of noise (in the Regent St store), asked to speak to the manager etc... He came over, apologised, said we were actually in the right, then gave my friend a new set of Bose speakers, plus his broken ones back."Boonowa tweepi, ha, ha."0 -
Tell game that you want a new xbox 360 under the sale of goods act you are intitled to a new system plus add damaged games to be replaired like for like aka new.
My local game is very nice. Back in Decemeber my 360 dead and I got a new concel then that one failed so I just contacted microsoft to fix it and they send a new one out, just 2 more faults and I get a game or two out of microsoft.0
