Help required for mutually agreeing not to proceed

Blinking newbie with feedback of 17 (84% positive) has won my auction and then won the same thing a few minutes later from another buyer for less money. Now apologising profusely that her daughter was bidding, bla bla bla, complete lie I'm sure as her feedback is crap and she does this all the time, but I want to do a second chance offer pronto, so don't want to wait 7 days before I can do a NPB claim. And then another 7 days I believe for her to not respond.

I've therefore gone down the mutual agreement route and have opened the dispute this afternoon. So far it says no response. I emailed her when I opened the dispute and told her what I was doing and to look out for an email from ebay which she must respond to so that she doesn't get a NPB strike and I can reclaim my fees.

My question is, being fairly inexperienced at selling, is what as the other party will she get - do ebay actually email her, or is it a case of her having to log into My Ebay or something like that? I've read on this forum that if she doesn't do her side of it correctly that I won't get my FVFs refunded and as it is quite a hefty winning bid, I don't want that to happen. Has anyone ever given a buyer specific idiot proof advice on the process involved that I could borrow wording from? Or can anyone point me in the direction of a link? I'm feeling a bit panicky :rolleyes:

Also, assuming it all goes through ok in the end - can we both still leave feedback?

    This is correct... which is why in 99% of cases you shouldn't do a mutual. Your buyer has done it before - why let her off?

    Unfortunately the only advice I can think of is don't do a mutual if your buyer is a muppet :(

    I've never been on the receiving end so I don't know exactly what she'll get.

    Because if I leave it any length of time before I relist, the value of my particular item will have gone down.

    If necessary I will phone her to talk her through it, but I need to know what ebay actually send to the buyer in these circumstances. Anyone know?

    I want to do a second chance offer first - don't think I can do that until the dispute is done and dusted, tell me if I'm wrong.

    Have you had a particularly bad experience with the mutual thing? I've just been having a read and it seems to me that the only way I wouldn't get my FVFs refunded is if she responds to ebay and disagrees with the mutual. I can't see what she would have to gain by doing that - or am I missing something. If she doesn't respond within 7 days, it says I get my fees back and she still gets NPB strike.

    I wasn't sure about that, it all sounds so vague - says before making 2nd chance offer, you must ensure that you've done everything necessary to resolve issue with winning bidder. I took that as meaning the dispute had to be closed first.

    I thought if she failed to AGREE... you also lose. The whole point of a mutual is that both parties have to agree?

    So, afaik...

    If she disagrees (out of stupidity, or maliciousness) you lose fees.
    If she ignores you (out of laziness, or maliciousness) you lose fees.

    Risky odds imo.

    This is the stuff I found under heading 2 - certainly seems to say my fees are refunded if she fails to respond - or am I misunderstanding it?

    I appreciate that if she disagrees to the mutual I won't get my fees back, but those are the only circumstances and like I say, what good would it do her to disagree as she will have a NPB strike against her.

    You don't get strikes with mutuals.

    Yep, just reread it - if she disagrees with the mutual, she doesn't get a strike and I don't get the fees back - every other scenario I do get them back. But can't see why she would disagree to that unless she is a total numpty (her email didn't suggest that) or just plain nasty - and I've been pleasant and reasonable throughout. Keeping my fingers crossed very tightly :rolleyes:
