Expansys want £35 to return my phone

    It's their word against mine though, isn't it if they imply I damaged the phone? Also, I had to post the phone to France so does SOGA apply? I ordered through the Expansys UK website.
    As you have been told above, they have to do more than imply.

    Here it is again...

    During the first six months after sale any fault can be assumed to have been present at the time of sale, although maybe not apparent at that time.
    It is for the seller to prove otherwise.

    They have not yet proved to you that the fault is not inherent, have they?

    As suggested above, it is perhaps time you wrote them a real letter.

    State that you expect them to either prove that the fault is not inherent or provide a remedy under the Sale of Goods Act.

    State that you are giving them 14 days to reply.

    State that if they don't do that you will use the small claims court process to recover you money.

    Head it Letter Before Action.
    Send it Recorded Delivery.
    Send it to their Marlow address on their contact us webpage.

    Where you sent it to be repaired is not important in this context.
    You bought from a UK Limited Company (company number also on that webpage).

    Good advice there, thanks very much. I will do as suggested. Sorry if I sounded hesitant. Someone on the other thread wrote that the £35 charge is reasonable so I had some mixed advice.
