Which is basically a much nicer way of saying what I said.

If you go in all guns blazing, being abusive and expecting trouble, you're far less likely to have a successful result because you'll get people's backs up. It's nothing whatsoever to do with mental health but everything to do with good manners and a reasoned approach..

Exactly. Additionally, if anyone feels an advisor is becoming "abusive" then the way forward would to be ask to speak to another advisor.

How someone comes across face to face in such situations can have an effect on the attitude of those helping.

I was self employed and due to needing knee replacements I signed on sick unable to physicly continue trading. l wouldnt need to be signing on if I was able to have surgery. I have now been waiting for nearly three years! I dont need to find a job all I need to is to be mobile again and I can go back to being self employed!!
If I dont have knee replacement surgery my GP has told me that I will become crippled.... who wants that?
No benefit system should be that complicated that anyone with a modicome of inteligence should require help to even fill out the forms.
I can give you an example of advice that I recieved from the CAB recently. My elderly mother went missing ,she lives 450 miles away from me. The police couldnt find her at first but she had been admitted to hospital after an accident in the city. I got the paperwork to apply for a grant from the social fund and first e-mailed cab for advice on if I would be able to claim for fuel costs to go up to help her. At my mums home I recieved a call from someone at CAB telling me that I would not be able to claim my fuel costs back from visiting my sick mother.
I submitted the fuel recipts and got over £350 paid back to me!

Very few people of working age have knee replacement surgery; most people have to wait until they're much older

If you really did receive £350 fuel costs for visiting your mother then I'm afraid that seems quite appalling.

She could not understand that even though I was signing on for JSA I could not tell her what work I would be able to do as I cannot walk ,sit ,stand ,or kneel for any long periods of time!

So what do you do at home? It sounds like a strange thing to say.

    Why is it strange, FBaby?

I don't know anyone waiting for 3 years for a knee replacement IF they have been put on the waiting list. It could be that the patient is asked to stop smoking of losing weigth though, but if you've been on the waiting list for 3 years, then something is very wrong.

Because unless OP is bed bound at home, she would be either walking, sitting or standing simultaneously at home, just like she could be at some jobs. If she mostly needs to sit, but needs to walk at time, she could maybe be doing some desk job with regular breaks. If she needs to be standing and walking, but needs to sit down at times, she could maybe be working in a shop etc...

What if she can't sit, stand, walk for long periods, due to pain? Can she still work, with pain severe enough to restrict how long she can do those things?

As I'm in that position, personally, I didn't find it a strange comment.

It may be she has another reason for not being able to do those things but I based it on my situation. No idea if the reasons are the same though.

What I am saying is that clearly, she will be sitting standing and walking at home. It might be that she needs to go from one position to another regularly, but she will be either sitting, walking or standing during the day at home (unless she is bed bound, but then I can't see how she would have failed ESA).

The point is, how can she be so certain that there is no job that could accommodate her need to move regularly from one position to another?

I am not saying that she could do many jobs, maybe none would be suitable for some time, but I don't understand how anyone can assume that they couldn't do any work at all so that it is not even worth considering potential options if they've been told they can't claim ESA.

you need to find someone who can speak to these people on your behalf if you are fininding it difficult to deal with
if your are suffering from mental health issues go along to your local MIND centre and have a chat with them and they can usually find you someone to help you with such things
Replies to posts are always welcome, If I have made a mistake in the post, I am human, tell me nicely and it will be corrected. If your reply cannot be nice, has an underlying issue, or you believe that you are God, please post in another forum. Thank you
