I will try to keep this short.I am getting quite desperate for help in the absence of getting proper legal assistence my problems just seem to be getting worse.
I have been claiming ESA since Oct 2009 , Failed the assessment then waited two years for the Tribunal ,consequently couldnt recollect much about my assessment my medical condition was much worse than that in 2009 and I was suffering with different conditions that had not been put on the original form ! Failed the Tribunal. Was informed that as I had to wait two years for the Tribunal I could claim ESA straightaway.
I have just had my new ESA claim stopped as I failed to attend the assessment. I could not afford to go to the assessment and sent a recorded letter to the DWP informing them beforehand that I could not afford to go and that I would need help with this ( this is what they told my MPs office I should do).
Incidently one way of the journey would be more than the ninety minute rule whereby I would be entittled to a taxi but Atos refuse to accept this.
I have appealed the ESA decision but have heard nothing.
I went to sign on JSA and my interview was terminated by the advisor when she became so aggresive I turned on my dictaphone to record her. She could not understand that even though I was signing on for JSA I could not tell her what work I would be able to do as I cannot walk ,sit ,stand ,or kneel for any long periods of time! The letter informing me that I could no longer claim ESA also said that the jobcentre would take my medical conditions into account when I signed on for JSA but this is not the case.I am now furious that as I am no longer able to claim ESA it apparently means that I may not be able to go into hospital for the knee replacements that I need as I would lose all benefits. I face losing my home if I am not entitlled to claim benefits. I am obviosly not in a physical position to look for full time employment at the moment and I am not happy at being forced to say that I am.I have had no money coming in since the 1st May and am now broke. The police had to come out to my house because they were worried that I was going to harm myself. Thats how bad things have got.
The citizens Advice Centre have been absolutely disgusting so please dont even mention them to me. My MP is useless.
I find it soul destroying to find lots of people going through similar situations but there,s not a lot of help out there.

    When someone has a bad experience with everyone they deal with (including their MP and the CAB) one really has to wonder whether the problem is actually one of the person's making.

    Hi gypsyjanet, I'm sorry your going through all this it must be awful. Have you tried calling the Benefit Enquiry Line and discussing your options? In what way have the CAB been unhelpful to you? I know they get quite busy, have you booked an appointment with them to see someone or just talked on the phone? They are normally quite good in these situations.

    If your really struggling you can go to a Food bank so at least you have some food. Give them a call for details of your nearest one. I'm not sure if you can get a Crisis Loan but it's worth looking into if you haven't tried already. Good luck.

    Edit: forgot to ask, do you get other benefits like Housing Benefit at all? If not that might also be worth looking into.

    I am absolutely staggered that I now have to contend with the possability that there is somthing wrong with me mentally as well as physically. i had the police out to my house because all this crap of ESA and the jobcentre had made me suicidal so you have no idea how your remarks are going to effect me.
    I was hoping for some constructive help but now I know that there is not going to be any.I have recieved two appologies from the jobcenrte and it was only one individual there was a problem with, My Mp is a Tory and couldnt give a toss about people on benefits and as for the CAB they can only give advice if they know the answer and facced with losing my house they were more concerned that I apparently given the wrong birthdate on all my past case notes!!!!
    I dont have a problem getting on with people I have a prtoblem with people that make rules and then bend them to suit themselves

    No one can give advice unless they know the answer, what do you want them to do make something up to tell you?

    In addition to Ineed's post, which gives excellent advice, please see of welfare rights are available in your area and try and make an appointment if so. If not, then CAB (seeing a different advisor) and ineed's advice are the way to go.

    Which is basically a much nicer way of saying what I said.

    If you go in all guns blazing, being abusive and expecting trouble, you're far less likely to have a successful result because you'll get people's backs up. It's nothing whatsoever to do with mental health but everything to do with good manners and a reasoned approach..

    So what do you do at home? It sounds like a strange thing to say.

    The reality is that you failed your ESA claim as they deemed you were able to work. If that is the case, why didn't you give the job centre a chance? Maybe there is something you could do, part-time. Wouldn't it be better to try to work with them, listen to their suggestion. If you prove them wrong, then so be it, but if there was a chance of doing some work despite your limitations, wouldn't be worth giving it a try?
