Ruled that an "agent" has no powers to form contracts with the motorist; and from there, obviously, has no power to take anyone to Court in its own name. Case at Scun thorpe was kicked out for that reason. Likely pretty much all court cases brought by PPCs will now fail thanks to the ruling. Bad news for those foolish enough to bring several cases....................0

So unless a PPC either taken on some ownership of the car-park then they have no case to bring (not that they did anyway?)

One question that must be asked is "do we actually need an appeals service?"
It would be much better if motorists just said to PPCs "take me to court". Then you take away all the uncertainty of whether the PPC is justified in asking for that sum of money, and (in the light of recent court rulings) if the PPC has any right in taking the case to court. In addition, it will swamp the court system and make the PPCs even more unpopular with the judiciary.What part of "A whop bop-a-lu a whop bam boo" don't you understand?0 -

Of course you could "play the system". Insist that the case is looked at by the the IAS then (because the findings are not binding on the motorist) say you don't accept the finding if it goes against you and insist it then goes to court. In other words, "put up or shut up". Thus forcing the PPC to take you to court or just drop the case.
This will waste a lot of time and money for the PPC and the [STRIKE]BPA run[/STRIKE] "independent" IAS, and fowl up the whole process.What part of "A whop bop-a-lu a whop bam boo" don't you understand?0 -
