This is why i asked, apparently if the education is higher than A level it stops when the education starts0

ankspon you are correct, it stops when the child enters further education (but would continue it the child was in 'non advanced" education, such as an NC course at college)
I would contact child benefit (in writing) to inform them that the child is in further education, it would then be down to the PWC to prove otherwise.
I would write to the CSA and advise them of the facts and of what you have done with regard to child benefit and would suspend payments pending the child benefit decision if it is not made before the cut off date in September.0 -
Well my son was in further education but not higher and it continued until he was 19, I think you are mixed up between further and higher, further it continues, higher level 4 or above it does not.Blackpool_Saver is female, and does not live in Blackpool0

Are you in contact with the child? if so ask them for proof of this which you could forward to the CSA.
Or....bit of a long shot...but one we've just had to do...contact the CSA yourself informing them....in our case they contacted the PWC ...who eventually confirmed QC was no-longer in education.....this was after CSA informed PWC they could be claiming CB frauduently.
The CSA don't accept any evidence from children in cases.0 -
Can I butt in here and ask is it different if the 18 year old is NOT going to university?
If the child has finished school and has no intention of going to further education?0 -

We did this before when the child got thrown out but they did not do anything,we was supporting the child outside the home and could not afford to pay CSA as well so we told them the child had been thrown out and our payments were stopping, they then told us later on we had over a thousand pounds of arrears even though the child was not at home.0 -

I bet they used child benefit as their excuse for this....when it is not the be all and end all at all, as my successful appeal proves. As it stands I stopped paying child support ten weeks before the child benefit ceased to be paid. My appeal states that they altered the date 'in accordance with the law' which, surely proves that a child benefit award is NOT the magic weapon that the CSA continue to insist it is?0 -
That's probably what's needed Nicky, more people like yourself fighting it! If they start to get inundated with CSA/CB queries, someone might just start to look into things a bit more closely. But while everyone takes it as "gospel" and coughs up, nothing will ever get done!0
