When you make a claim off your own insurance policy, irrespective of "blame", your insurer will usually make you pay your excess (which you must claim off the third party along with all other uninsired losses), and reduce your NCD (if not protected) until they have been fully reimbursed by the other side.
But if you keep your own insurance out of this, and claim directly from the third party (or let a claim handler sort it for you) then no excess to pay, and no impact on your NCD. (Assuming liability is accepted by the third party!)0 -
just phoned insurer and the other person has accepte full liability . can someone let me know what my rights arew from here.0

You can now safely pursue the third party insurers directly, and not claim off your own insurance
As this is all new to you, a claim handler looking after things is your best bet.
If you google cashback accident solicitors you will find solicitors who will pass on £hundreds to you as a commission for giving them your business (your insurer will get around £800 commission if they pass you on, so cut out the middle man and get it yourself). A claim handler solicitor will sort out your injuries as well as your car.0 -
thanks ver much for ur help quesntin. my insurer has passed me onto a lawyer but he takes between 10 and 20 per cent. called digby brown and there argument isx that the lawyers that claim no win no fee and no fees at all dont get as much mney as they would. can you tell me are they having me on or is this actualy the case. i would have thought it would have been more or less the same whichever lawyer to use but 20 % is a large amount.0

Yes, they are having you on big time!
Decline their offer.

No, they don't deduct it from your claim - you will see all the figures relating to your claim, and there will be no "deduction".
The lawyers make enough in fees anyway (paid by the other side). That's how they can afford to pay £800+ to insurers for passing on leads (like you) to them0 -

Isn't whoever "sorted" the car hire also doing everything else?0 -
no car hire is from the 3rd party insurance. the total loss for car is being dealt with my own insurer i asked they say it wont effect my NCD or my excess.
ive had my own insurer tesco call me about pesonal injury who pass my stuff to digby brown and the 3rd partys insurance has said they will call me later regarding personal injury.
what is best to do still go get my own lawyer for personal injury that gives cash back or just go wityh the 3rd partys insurance for everything.

my insurance said that i will get a quicker payout regarding total loss from them tha i would from 3rd prty who is admiral.
