Bought a car without warranty where do we stand?

    Just to clarify

    You dont *need* to buy a car warranty from the seller as you already have quite comprehensive rights under the SOGA.

    If you have been working with the supplying dealer to resolve these problems since you bought the car, then i'd say you still have a very good case IF there has been a FAILURE of the engine - assuming it hasnt been caused by neglect or misuse.

    Otherwise at this stage it may prove more tricky as the dealer may argue that you've had the engine worked on independently, therefore they cannot be held responsible, and also a considerable time has passed since you bought the car.

    BUT, personally, i'd get an INDEPENDENT inspection (ie, not by YOUR mechanic, but by maybe the RAC / AA) with a view to

    (a) in the first instance, taking this info to the dealer and asking them to repair / replace

    (b) if that fails, talk to Citizens Advice with what your next move should be - they MAY recommend having the repair done and claiming the cost off the dealer via the courts.

    Have a read at this and try to map your experience / dealings with the motor trader so far, and see how you can use the SOGA going forward to help you.
