    My dog is a 13 year old Jack Russell who has arthritis,he was not on as lead as he never leaves our side & We walked into our local village club & the Bull Terrier/Jack Russel cross who was about 4 meters away on a extendable lead which was fully extended lead ran over grabed buster by the front leg & started to drag him abut.I got on the floor & broke it up while the owners of the other dog did nothing to stop the attack.They were just verbally abusive towards myself & my wife.This is the third time this dog has attacked Buster & twice he has had to go to the vet because of this dog.The dog is not allowed near its owners mums dog as it has done the same to that dog.

    I'm so sorry that your dog was hurt but, being realistic you would probably be lucky to get half the vet costs, probably paid at £10 pw through a civil action in the Small Claims track of the County Court. Your dog, technically speaking was also out of control (I know he wasn't but a lead is the usually accepted definition in cases like this) and unless you can get other people to make a statement saying that the staff has attacked their dogs in the past, it's just hearsay and can't really be used even in a civil court.On a balance of probabilities you could lose the case. Sorry

    In saying that, I'd probably go ahead and sue them, if only to cause them hassle in responding, I'd also encourage anyone else who has had problems with the dog to report them to the dog warden - this will allow the DW to build a case over time which could have the owners facing criminal charges under the DDA. Yes I'm vindictive and truly believe that what goes round comes round...
  • I was chatting to another dog owner when i was today & guess what.The same dog has attacked her dog & she had a mouth full from the loacl chav as well.She's more than happy to right a statement.
  • Well letter posted to them.Went into the village post office to send by recorded delivery & the postmaster looked at the name & said... "watch yourself,as when i refused to service him fags when he was under age he threw acid over my car" Nice some people are pure class.

    The thought of another dog attacking my dog is something that puts me off getting one, i don't know if i could protect my dog from a really big or strong dog. OH seems to attract mental dogs, he has been bitten (once climbing in a very remote area and the non-stereotypical aggressive dog owner blamed him and left him!) or growled out by so many dogs so can only imagine him+dog would be even worse.

    I have two pedigree staffordshire bull terriers - both are extremely soft. The breed of the dog is irrelevant.

    Dog on dog attacks are civil and would need to be dealt with via a small claims court. You could speak to the council. Dog owners can be given sanctions and then if they are breached it MAY result in them having the dogs siezed and removed.

    Dogs fight with dogs and this is not a criminal matter. If it bit a person it would be different, but dog fights are dealt with via a solicitor.

  • Yes your right,The breed of the dog is irrelevant.As i wrote in an earlier post we have had Bulldogs & are looking at getting a couple of Staffies at some point.It's more the point the young couple who own the dog im finding out letting the dog do this all over the village.The dog warden contacted me on Friday & will be paying them a visit with the police next week.All so i have wrote to them inviting them to pay half & that if they dont reply then small claims court online.
