Dog Attack

Must be round here then, because a "staffie" is whats known as a pitbull cross breed given a silly name to escape dangerous dogs law.
A stafordshire bull terrier is the name given to a pedigree staffordshire bull terrier.
The staffies dont have any papers because they are cross breeds which do not meet breed standards and are generally owned by Thick Chavs who walk around fiddling with their private parts by placing their hands down the front of their trousers.Hi, we’ve had to remove your signature. My sister has staffies and has actually bred from one of them ( a long time ago ) and pits up here are certainly not staffies unless the owner of the pit calls them that to disguise what they really are. Up here they are usually referred to as American bulldogs which again they're not.Must be round here then, because a "staffie" is whats known as a pitbull cross breed given a silly name to escape dangerous dogs law.

Right you have a very good case for damages.
Firstly this dog needs to be reported to the police.
Keep all paper work and only send copies.
Make an account of what you have lost and send your account to the owner of the dog with 14 days to settle the account or make arrangments to do so.
After 14 days send them a NOTICE BEFORE ACTION stating that if not paid you will seek a CCJ against the owners or keepers of this dog.
Then file a money claim on line stating the facts.
They may not pay, but they will have a ruined credit rating.
The case will be a very easy win.
This was my plan of attack(no pun intended)0 -
Hope you dog is okay,
Some people shouldn't be allowed a pet if they can't control them!0 -
Under the Dangerous Dogs Act (1991) as their dog was on lead and yours was not then you are deemed the one irresponsible and having an out of control dog.
It might sound insane (as it kind of is) but in the eyes of the law they have control over their dog (leash), you do not.
From their point of view they could argue that your dog wandered up to their on-lead dog and caused a reaction. Therefore they are not liable.
Having said that, as the dog has previously attacked other dogs I would call the dog warden to see if an order can be placed on their dog to prevent future attacks.
This has been mentioned elsewhere on a dog forum I'm on and the general gist was that on-lead does not necessary equal in control, and vice versa. The DDA doesn't cover dog-on-dog attacks anyway, so if the Staffie cross was showing no aggression towards the humans, just the dog, it would be a civil case of "damage to property" or similar I believe (unless OP is in Scotland where the laws are different).
Anyway, we can only go by our interpretations of the law so I'd suggest getting some professional advice. The Doglaw website states that they give free preliminary advice for some cases, so perhaps phoning or emailing them and asking what to do would be an idea - http://www.doglaw.co.uk/
If you have dog insurance then your insurers may cover the legal costs to persue this further.
And yes, Staffie is short for Staffordshire Bull Terrier. As Sheltie is short for Shetland Sheepdog, Rottie short for Rottweiler, Bullie short for English Bull Terrier, Dally for Dalmation, Chessy for Chesapeake Bay Retriever, Newfie for Newfoundland, Scottie for Scottish Terrier...the list goes on. I'm sure there are many people who call their Pitbulls "Staffie crosses", if they have the sense to not outright admit they're Pitbulls, but that's no different to those who pretend their joints are regular cigarettes when caught by the police, carrying a penknife as a weapon rather than for the cockscrew feature on it, hiding alcohol in a water/juice bottle and so on. Doesn't mean every bottle of water is really vodka, or that penknives are only used as weapons, etc. - just that they have become handy guises for the criminally minded to get away with their illegal activities.0 -
Rang the council today & the the dog warden will phone within 24hrs.I have since found the same dog has done this to other dogs around the village.i plan to take them to the small claims court online if they dont offer to pay at least half, ive got to take my dog back the vets tomorrow,And i will get the notes from the treatment & copy of the bill for the attack before this one.0

Firstly Staffies and I mean staffies not pitbulls do "Let go" of anything if trained properly.
Secondly,
I had this my staffy was attacked twice by the same labrador. The first time the police were not interested until i pointed out that if it were the other way around it would be all over the news.
The second time he was attacked the dogs owner stood and laughed at the thought of his lovely soppy lab attacking a staffy. This too was reported to the police along with the fact that i had to have stitches. He was spoken to by the police and after he received a letter from me threatening court action unless he paid both vet bills he paid up.
Wasn't quite so funny when it hit him in the pocket.
Also it wasn't the dog's fault the owner was a complete idiot.0 -
I agree with the above comment we've not had Staffies but are talking about after our present two dogs pass away.We Had two Bulldogs until 18 months ago & people would cross the street when they seen us coming but when they got to know them. They couldn't believe how soft they were.I say yes its down to the owner not the dog.0

We had a local %%%head round here a few years ago who would let his " staffie" off to attack other dogs, it had killed a King Charles and he thought it was very funny.
He did not think it was very funny when I thumped him for some strange reason.Hi, we’ve had to remove your signature. If you’re not sure why please read the forum rules or email the forum team if you’re still unsure - MSE ForumTeam0 -

I agree that there are some terrible owners but there are also bad dogs. My first dog Ailsa ( a sheltie ) who was and always will be the love of my life was killed by a staffie 5 years ago, the thing was and is still owned by my sister, it was well socialised, well trained and my sister is a very experienced staffie owner. The thing and I'm being polite at calling it that walked up to Ailsa and bite her once piercing her skull and killing her. My sister offered to have the thing pts but I said no, it's now only walked in the country where they hardly ever meet other dogs, it's also muzzled and if any other dogs are near it's on it's lead. We have also learnt that other of it's litter mates have attacked dogs and that one of the pups when it was just 4/5/6 months old attacked and badly injured it's mum. I do believe that most of the bad dogs around have bad owners but honestly there are bad dogs out there as well.0
