The policy document can say what it likes, it is just that policy, the OP has legal rights as well, no policy is above the law..
He has obliged with offering a chance for repair this failed.
So what. There's nothing in the legislation that says a retailer can only have one go at a repair. They can offer a remedy of repair as many times as they wish as long as it doesn't cause a significant inconvenience and can be done within a reasonable period.

Personally I'd allow them one final go and if it isn't resolved then push for a replacement or refund (partial).

Partial refund, that would take the pee.

Right now, its extremely inconvinient as it was 3 hours on the phones yesterady morning with them , now I am having to research it online again this morning. Plus the no TV front. I havent even completely removed the bubble wrap that it got returned in as I refuse to take any risks with them claiming its new damage. So I am still without my new TV. Then we to have arrange pick up, sometime next week and then to be returned some time in the future. Its all adding up to the inconvenience. In none of there information does it say we can take multiple cracks at repairing a product. However it is strongly suggested how many a consumer has to put up with. It's not in the law, but it does lend weight to it.

They could not even give me an expedited repair or a loan unit.

Svenholio, unless you are bed bound being without a TV may be inconvenient but isn't significantly so.

The WEH policy does state the repair will take a maximum of 21 days, anylonger and a exchange or vouchers to at least the same spec will be issued, a repair is classified as either one repair or several repairs carried out within a short period of time.

The WEH is also classified into two categories premier and club, premier guarantees 7 day repair or a exchange/vouchers and a loan system whereas the club guarantees 21 days but no loan system.

At this point Currys have not broken any consumer laws or their own policy, so letting them repair it again is your only/main recourse of action, and is reasonable to do so too.

The WEH are not very helpful in this as they have already had the TV for repair. Its says in those that also the 21day time frame will begin again on each occasion aswell. So althought they have had the TV for 7 days and done nothing, they get to take it away again and potentially keep it for a further 21 days?

The inconvinience is in having no TV. The policy does not state one or multiple repairs, not in any of the documents I was passed.

Also, with your opinion on no tv being inconvinient and allowing multiple chances to fix it, they could never fix it and I would be able to do nothing.

No, the 21 days doesn't start again after the repair, there is a leighway time which is 7or14 days where if a fault is reported within that timeframe it still continues the repair countdown (but say you reported the fault to having it back took 7 days, and you reported same/by-product of repair fault a further 5 days after receiving it back, and was picked up again and took a further 7 days, it would count as a 14 day repair not a 19 day repair).

Nobody has said that they could attempt to repair it indefinitely, that would of course be unreasonable.

Please read my earlier post again they are entitled top offer a remedy that does not cause a "significant" inconvenience and is carried oy within a reasonable period. I would allow them one more attempt to put things right before demanding a replacement or refund, and yes they are entitled to offer a partial refund to deduct the 6 months use you've already had out of the TV.

Sven, I had a similar problem with a faulty tv. If Currys are being unhelpful, try speaking directly to the manufacturer of the tv and getting their opinion.

Currys have not upheld their contract you entered into when buying the tv, and if they cannot fix it, they have to replace it.

Do not be put off by comments suggesting it cannot be done, it can. Ring them daily stating you problems until they can fix it, and if they fob you off on the phone, go into the store (if possible) and do not leave until they at least agree to look at it again. If this is the 2nd time they are looking at it there is no reason it shouldnt be fixed, or if it cant be, replaced.

    Good luck
