Never received a ticket

Hi All

Having come home to letter from the local council advising me that I received a parking ticket on the 19/04/12 at 13.04pm for 'Parked in a suspended bay/space or part of bay/space' I'm not a very happy bunny and would love some help.

My points are as follows:

1. There was no ticket on my car when I got back to it after work and I'm sure if there was that either myself or my DH would've noticed it.
2. I park in a disabled bay and always make sure that I am well within the lines of the bay (and show my badge).
3. There was no notification of parking being suspended otherwise I would've moved to a different carpark.
4. Why would the ticket have only been issued at 1pm considering I would've been parked there since 9am and surely other inspectors would've done the rounds already.
5. How the hell do I prove all of this when I'm only now being made aware of the ticket.

I truly appreciate any help that you could provide as I've looked through the guide already but I couldn't see anything that worked for when you never received the ticket in the first place.

    Ask to see the photographic evidence would be an idea. Then at least you might have a clue what's going on.

    Do not post on this thread below, but with a quick browse on pepipoo I found one on there recently which is very similar to your case = suspended bay (allegedly) with no PCN found on the car. Worth a read to see the sort of info and pics you need to post in your own thread:

    Most suspended bay signs are not compliant, which is good news for you. So you'll have grounds for appeal to do with the yellow 'alleged suspended bay' sign itself and the fact you say there was no sign even there at the time.

    And the fact no PCN was served should be stated in your challenge - ask for all photos taken and a copy of the CEO's notes and proof that the suspended bay sign that contend was there, is specially authorised by the DFT. There may be more grounds that pepipoo will suggest as well.

    Bottom line - DO NOT PAY. APPEAL. You have missed the 'chance' (LOL!!) of paying the discounted amount as you are straight to NTO stage. The penalty does not increase now; even if you went to adjudication and lost, it would still be the same as on that NTO. And the fact is that most people who take a PCN to adjudication win, and actually pay nothing at all.

    So you are not risking anything by challenging this all the way, as long as you don't miss any deadlines.

    Get over to pepipoo sharpish and let us know in the end when you win.

    Thanks a lot for the responses you've been a great help in directing me as to what the next step will be.

    I will contact the office tomorrow and ask them to provide me with proof of the alleged offence and take it from there. As you say it's not like I've got the chance to pay the reduced charge lol.

    You won't get far without a full appeal, and you certainly won't help yourself if you try telephoning. Not sure if that's what you were planning but never phone about a PCN. There is lots more you can put in a formal appeal letter than asking for their proof. You could miss a trick here if you send a short letter as this is your ONLY formal appeal chance.

    I agree, keep all contact in writing. I am not saying a council would lie about a telephone conversation, but frequently the quality of the staff they employ is very poor- as evidenced by the number of appeals they lose before adjudicators.

    Have only just seen the replies about phoning so have made a booboo already but seen as I work for the same council I thought I'd give them a call but the person I spoke to said to put my request through in writing on the form provided so will be doing that.

    As suggested I'm going to scan the paperwork I received in and put a thread up on Pepipoo to get the best way to respond to them.

    That's ok I'm used to the stick I get as a council employee, luckily I don't work in any of the horrible departments ie council tax etc :rotfl:

    Well evidence has now been provided and looks like I parked in the only spot that was marked off from 12.30pm to 6.30pm. Unfortunately the evidence is pretty clear that I'm going to have to pay the fine but luckily they have put it back to the £35 if I pay within 14 days.

    I'm still going to check over on Peppipoo about it but it seems pretty clear cut to me.
