santander incorrectly charged me. Please help

    Although you don't see it as fruad. It is that department that can move the money to the correct CC account. It is very unlikely that Santander got it wrong twice, so it sounds like the person who owns the money sent it to your account using your CC Number as the ref.

    If that was the case, then that is a massive error on the Branches part and can be seen as breaking the DPA.

    Well heres what happened:
    There was a mixup between mine and someones elses account. The other person made 2 payments to my account. They contacted santander as soon as the realised they had been paying someone elses account (my account) and santander refunded the money back to the person who made the payments.
    The fraud department have told me that the person who made the payments to my account also went back to the bank where they made the payments from and the bank recalled the payments. Thats why I have been charged for one of the payments twice.
    I phoned the fraud department on the 28/05/12 and they explained the above to me and they said that they had to email the payment proccesing team in order to get the money refunded back to my account. The lady i spoke to told me that she would monitor my account and as soon as it was refunded back she would phone me to let me know.
    I have not been making any payments to santander and have been pestered for payment. I keep telling them that there is a mistake on my account which the fraud department are dealing and im nit willing to make any payment until its been sorted as they are asking for money that i do not owe them.
    Over a month later now and i got a bit fed up with waiting and being pestered for payment so i phoned them again on monday. They explained the same thing to me with how i got charged the amount of £3887.01 and agian said that they had to email the payment prossessing team.
    I was a bit suprised that nothing had been sorted from the first time that I phoned them back in may.
    They are aware of the mistake so shouldnt they refund the money back to my account straight away?
