JD Williams Group....what a joke

How does this company get away with intimidation beats me. I currently have a problem with them in which they just don't care.
They are chasing me for 2 accounts that are not mine and I've told them this but get no joy. Details have been entered onto my credit file because of none payment and a debt collection agency was told to take over the chasing, but after I spoke to them sent it back to JD Williams and was actually rather helpful (shock I know but hey).
Now I have requested proof of these debts in which they have refused to send (refused as I have it in writing) and will not enter any further discussions. They won't even remove defaults they have entered onto my credit file, bearing in mind they are aware that the debts are not mine. In fact in 1 letter to me they have stated that they will not send any proof to me as the accounts are not mine and it would breach the Data Protection Act.
Now as it stands, if an account is in dispute then it shouldn't be sent to a Debt Collection Agency (OfT guidelines or something like that). I've had the threats of someone coming to my house (oooo I'm really scared) and even had the daily phone calls (at least 4 a day) but they soon stopped when I advised them that all calls are getting recorded.
Now they want some proof of me (which I have sent twice, both times recorded delivery) which has mysteriously vanished.
Now I have been told that as they have failed to follow procedure set by the OfT and the Consumer Credit Act then when the matter goes to court (hope it's soon I'm getting bored of them), then the debt will be unenforceable anyway.
But I have heard on the grapevine that JD Williams Group have had warnings before of doing exactly what they are doing now (the harassment and not following correct procedure), but I can't find any judgements or anything online.
Anyone any idea where I can find this?

What do you mean 'when it goes to court'? Do you have a court summons? It doesn't matter if it's unenforceable due to their inability to follow due process because they've already confirmed it's not your debt, so what does it matter? Why would they take you to court if they know it's not your debt?

TBH, your post is a little confused for me to understand what's going on.

To an extent they have said that the debt isn't mine by saying that they are refusing to send me any proof as I have said that the debt isn't mine.
However on their last communication (by letter I might add), they have stated that they will carry on the due process which could result in court action0 -
I may be wrong here but I don't think they can put a default on your credit file if you don't actually have a debt with them? My credit report lists all of my accounts with outstanding balances and payment history. I don't see how a company I don't have a debt with could put a default against this?

This sounds bizarre. Companies make mistakes, debt collection agencies are the devil's spawn, but.. at the end of the day, when they agree that a debt's not yours, that's (usually) the end of it. They're bound by law to remove any defaults on your credit file, plus they must call off debt collectors. End of matter.
TBH, despite your thinking they agree the debt belongs to someone else, it doesn't sound like this is their opinion at all. If they're still carrying on with their procedure to recover debt (and you have this in writing) then you've not convinced them the debt's not yours.
Forget about technicalities like following due process and whether they have a poor track record or not. If the debt's not yours, then you need to get proper acknowledgement of this! That's your defence, not their inability to follow due process.

I'm positive, but unfortunately they won't provide any proof or discuss the matter with me as 'it's not my debt'......yet it's my credit file they are putting defaults on:mad:
They have asked me previously to send them proof in, which I have done.......twice. They claim not to have received it yet I've got 2 letters from themselves thanking me for sending the information in. :huh:
Here's the best bit, one of those claiming not to have received this information is one of those that sent the letter thanking me for sending the information in.:eek:
Anyway I have managed to find their CEO's email address. Lets see if he gets something sorted0 -

That is what I am hoping, but by the sounds of it they can't even prove that the debts mine. Hopefully someone at the head office will make a few heads wobble a bit and it can be put to bed. Interesting to note that looking through the paperwork earlier that despite the debt being in dispute they are still adding £12 charges per letter.....a clear breach of the Consumer Credit Act. Mind you having said that so is adding defaults to someone's credit file.
I would have assumed that they would have had to provide proof of the debt to the credit reference agencies but obviously not.0 -
Not sure if you are still having problems with JD Williams (Fifty Plus).
I have had terrible issues with this company but seem to have found a resolve throught the wonder of social media. A carefully worded post on the fifty plus facebook page got my matter resolved in a number of hours,,, what I had previously spent months trying to get a response with.:j0 -
Can i ask how you worded your post on Facebook? My problem is a faulty tablet which they have had for almost 3 months. If the tablet could not be repaired I should have had a refund by the end of January. Countless phone calls to this awful company have acheived nothing. I have no tablet and no refund.0
