Spoke to Virgin again today. They told me that they listened to the conversation, and acknowledged the conversation that me and the salesperson had about me "trying it out". However, they said that the salesperson told me not to try it out (I rather think that she agreed with me, more than she specifically advised me, but whatever).
But I didn't "try it out"! I had an accident with it, one that I thought it would survive, based on the fact that it was offered as a selling point of the phone... Can I build an argument on the fact that my anecdote, and the fact that I even said I was tempted to try it out, clearly demonstrates that I had understood the phone to be waterproof?

The data controllers (Virgin) are allowed to charge you up to ten pounds to send you any data you request. I recommend that you ask for ALL the data the have stored relating to you.
