Was sold phone as "waterproof"...

    Spoke to Virgin again today. They told me that they listened to the conversation, and acknowledged the conversation that me and the salesperson had about me "trying it out". However, they said that the salesperson told me not to try it out (I rather think that she agreed with me, more than she specifically advised me, but whatever).

    But I didn't "try it out"! I had an accident with it, one that I thought it would survive, based on the fact that it was offered as a selling point of the phone... Can I build an argument on the fact that my anecdote, and the fact that I even said I was tempted to try it out, clearly demonstrates that I had understood the phone to be waterproof?

    Also if they have a recording, can I insist on getting a copy?

    Oh silly. Truth is, I saw it with my own eyes and was amazed! There was a whole group of us at this party trying it out! I completely believed it and told loads of people about it because I'm sad like that, and if it had turned out that it was a special case instead of an awesome phone, then I really would have been an idiot! You wouldn't need to imply that for me to surmise it.

    Yes you can, via a subject access request, under section seven of the Data Protection Act.

    I found that one too when I searched, but strictly speaking it is water resistant - not designed for submerging. ;)

    Also it says "water proof (up to 1m for 30 mins)" - that's more than resistant!

    I'll be holding you to that one. ;)

    The data controllers (Virgin) are allowed to charge you up to ten pounds to send you any data you request. I recommend that you ask for ALL the data the have stored relating to you. They have up to forty calender days to send you the data.
