Was sold phone as "waterproof"...

    I found that one too when I searched, but strictly speaking it is water resistant - not designed for submerging. ;)

    What would be the point of a submersible phone? You could not talk underwater into such a device and your not likely to be keen on sending texts whilst deep sea diving.

    If a salesperson makes a claim about the features and attributes of the goods he is selling, that becomes part of the contract. It doesn't have to be written down to form a contract.

    I cannot think of any smartphone that is waterproof. Some are splash proof, water resistant, but not actually waterproof. Also there are some waterproof cases available, which I imagine is what you saw?

    It doesn't matter whether you know of any smartphone that isn't waterproof, it is what impression the salesperson gave when selling the handset. There are lots of things that I don't know about that many people do (as I am sure there many things for you also). For example, I have no idea how facebook works, but I am sure that there are many who would scoff at such shortcomings.

    Contents insurance is relatively inexpensive. I'd recommend you get some quotes.

    Maybe not, but you certainly implied that she should have known before buying the goods.
