Was sold phone as "waterproof"...

It could have been the Motorola DEFY she was thinking of?
I found that one too when I searched, but strictly speaking it is water resistant - not designed for submerging.

What would be the point of a submersible phone? You could not talk underwater into such a device and your not likely to be keen on sending texts whilst deep sea diving.:A:dance:1+1+1=1:dance::A

Only if that info formed part of of the contract. It seems to me the OP had accepted the phone as it was, then was told something as more of a passing comment later.
If a salesperson makes a claim about the features and attributes of the goods he is selling, that becomes part of the contract. It doesn't have to be written down to form a contract. The greater danger, for most of us, lies not in setting our aim too high and falling short; but in setting our aim too low and achieving our mark0 -

It doesn't matter whether you know of any smartphone that isn't waterproof, it is what impression the salesperson gave when selling the handset. There are lots of things that I don't know about that many people do (as I am sure there many things for you also). For example, I have no idea how facebook works, but I am sure that there are many who would scoff at such shortcomings. The greater danger, for most of us, lies not in setting our aim too high and falling short; but in setting our aim too low and achieving our mark0 -
Well the point is that I made clear what my expectations were. There are smartphones available which are completely waterproof, I had just witnessed one and me and the sales lady had a conversation about it where we agreed how cool it was, and we were both excited that we both had one. To be honest I believe that she was genuinely mistaken.
There's no way of proving whether it was a crucial part of the sale, but my general expectation was that it would be fine immersed in water, just like the one I had seen, so I was less careful with it. I even said to the sales lady that I was tempted to try it out, and she didn't advise me against it.
Within 6 months, is it not the responsibility of the supplier to prove that the goods weren't "faulty or not as described"?
I don't have home insurance, no
Contents insurance is relatively inexpensive. I'd recommend you get some quotes. The greater danger, for most of us, lies not in setting our aim too high and falling short; but in setting our aim too low and achieving our mark0 -

Maybe not, but you certainly implied that she should have known before buying the goods. The greater danger, for most of us, lies not in setting our aim too high and falling short; but in setting our aim too low and achieving our mark0 -

So, you had heard of a smartphone that was waterproof.
