Not that I want to be a party-pooper, but there is an important variable missing from those calculations, which makes the 'odds' understated...
The only data we have on unpaid tickets is from the BPA itself, so extreme caution is advised on these figures, but they say that approx 31% remain unpaid after the chasing letters.

So that would be 558,000 unpaid annually.

    Chances of court claim = 845/558,000 = 0.15%
    Chances of going to court = 49/558,000 = 0.0088%
    Chances of losing in court = 24/558,000 = 0.0043%

Still makes that three-legged nag in the National a better bet.

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.

Yes, the three-legged nag is worth a punt at those odds. After all, the rest of the field might all fall over...

and the good news is that the VCS/HMRC ruling is going to bite into those odds even more as companies realise they have NO RIGHT to do court....

Thanks BP - excellent work. Really valuable.

As I understand it in the legislative impact assessment prepared for the governement by the DVLA , using BPA provided figures the totals actually cited of cases in which proceedings were allegedly issued was between 36,000 and 90,000.

At 845 the discrepancy is astronomic. One could almost forgive a single order of magnitude but this is an order of magnitude above that. It is so far off the mark one is tempted to suggest that either the BPA simply stuck a wet finger in the air or in the purported survey that was conducted of their members (on which the figures are based, apparently) the members guessed, straightforwardly exaggerated or just made it up as they went along.

As a consequence one is forced to ask quite how in touch with their members the BPA is? One is also obliged to draw everyone's attention to the evidence given by Patrick Troy before the Commons Public Bills Committee (at column 104 again) where in reply to a question from Shona McIsaac, MP our Patrick said:
We have total control over our members
On the basis of the this FOI discosure methinks otherwise me old cocker.
My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com

The basic mistake was that the Government got conned into believing the BPA had any form of independence from its members. Of course they were going to tell lies. It is standard practice.

If this information were to come out and the !!!! (I saved the system the bother) hit the fan, can we come up with any [STRIKE]excuses[/STRIKE] reasons for the BPA? :)

    Probably down to GCSE Statistics.

I have reason to believe that these figures are on their why "out" and my assessment, I'd suggest, is far from unreasonable.

My son's a member, does displays. Would love to put a rocket under ""them""

If he got a private parking ticket, would they let him off? :)
