Well the council have fudged it themselves
My bro sent me the dvd recording of the "incident" and photos the council have kindly taken of the road and markings as they are now including signage.
Having looked at the footage and photos there are numerous appeal points - the no vehicle signage info sign 618.1 is not a permitted varient as they have missed the No Vehicles off it. The start of the new BUS LANE 15M from the junction as shown in the TRO has no markings at all now identifying it as a bus lane, it also is still missing the hash lines. And finally sign 958 is completely missing from the start of the bus lane, and presumably 30m prior to that to warn of the approaching bus lane.

Long time coming but the result is in - appeal allowed contavention did not occur. Inadequate signage. Get in result
The bus lane in New Bond Street, Bath has, along with other bus lanes in Bath,
recently been the subject of a site visit by Adjudicators as part of the hearing of a
number of appeals concerning those bus lanes, the common theme of which was
that the bus lanes were not adequately signed. In the case of the High Street bus
lane the Adjudicators decided in, amongst other cases, Case No. BN 05565C as
follows:“New Bond Street1. We take note of the fact that changes were made to the signs in New Bond Street
in February 2012 and that there have been further refinements since the dates of
these contraventions. At the date of our visit, the road markings had replaced a
dotted white line proceeding at an angle from the right hand kerb to the centre line.
Traffic enters the street in a single lane and the effect of the road markings is to
lead traffic away from the bus lane. The Council has now removed a right turn
arrow but Mr Bailey accepted that it had been left visible by the original contractors
and that that might cause confusion. We agree with that concession. Whilst we
find that at the date of hearing the markings of New Bond Street convey adequate
information of the bus lane, we also find that in the spring and early summer ofCase Number BN 05582BPage 2 of 22012 the absence of the clear lane markings and inclusion of the right turn arrow
created inconsistency and were misleading. Accordingly, we find for these
appeals that the signage was not in accordance with the TSM at the detection
dates.”The signage present in New Bond Street at the date of the alleged
contravention in this case appears, from the evidence in this case, to have
been the same as that referred to by the Adjudicators in the decision from
which I have quoted above. I follow the reasoning of the Adjudicators from
which I have quoted and conclude that, on the date of the contravention in
this case, the signs did not give adequate notice of this bus lane.
Accordingly, I find that this contravention did not occur, and that this penalty
charge notice does not have to be paid. This appeal is allowed.M F KennedyAdjudicator 20 December 2012
